I, William C. Spencer of the County of Tyrrell and State of North Carolina being of sound mind but considering the uncertainty of my earthly existence, do make this my last Will and Testament.

Item - My executor hereinafter named shall give my body a decent burial, suitable to the wishes of my friends and relatives, and pay all funeral expenses togeather with all my just debts out of the first moneys which may come into his hands belonging to my estate.

Item - I give and bequeath to my beloved wife Sabra Ann, all of my real and personal property of every discription during her natural life, the lands as follows: the Ludford Cohoon place, the Sam Bryan tract and the Godfrey tracts formerly belonging to W. J. Armstrong and known as the W. J. Armstrong lands containing 300 acres more or less, and at the death of my wife, I give the whole of the above said lands to my two sons Enoch Nelson Spencer and Edward Henry Spencer to be equally divided between them.

Item - I give and bequeath to my children Nathan, William, Joseph, Mariah, Elli, Mattie, Fanny, Cottie, Premella, Ardelia, Minnie and Louis the sum of one dollar each to be paid out of monies arising from my said estate.

Item - I hereby appoint my trusted son Enoch Nelson Spencer my lawful executor to all intents and purposes to execute this my last Will and Testament, according to the true intents and meaning of the same and every part and clause thereof hereby revoking and declaring as utterly void all other Wills and Testaments by me heretofore made.

In witness whereof I the said William C. Spencer do hereto set my hand and seal this 27th day of December 1906.

Signed, sealed, published and declared by the said William C. Spencer to be his last Will and Testament in the presence of us, who at her request and in his presence, and in the presence of each other have hereunto subscibed our names as witnesses thereunto.

A paper purporting to be the Last Will and Testament of William C. Spencer deceased, is exhibited before me by Enoch Nelson Spencer, the executor therein mentioned and the due execution thereof by the said William C. Spencer and thereupon proven by the oath and examination of F. R. Johnston and C. V. W. Ausbon the subscribing witnessess thereto: who being duly sworn, doth depose and say, that each for himself, that the said paper-writing purporting to be the last Will and Testament of William C. Spencer in the presence of these deponents subscribed his name at the end of said paper-writing, which is now shown as aforesaid and which bears a date of 27th day of December 1906 .

And this Deponent futher saith that the said William C. Spencer, the testator aforesaid did at the time of subscribing his name as aforesaid, declare the said paper-writing so subscribed by him and exhibited to be his last Will and Testament, and this deponent did therefore subscribe his name at the end of said Will as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith at the same time when the said testator subscribed his name to the said last Will aforesaid and at the time of the deponents subscribing his name as a attesting witness thereto, as aforesaid, the said William C. Spencer was of sound mind and memory, of full age to execute a Will, and was not under any restraint to the knowledge, information or belief of this deponent. And futher these deponents say; not.

It is thereupon Considered, Adjudged and Decreed that said proof is sufficent and according to law, that said paper writing is and contains the last Will and Testament of William C. Spencer deceased. And on motion it is ordered that said Will be admitted to probate and recorded in the Book of Wills of Tyrrell County and as such filed as provided by law in the Office of the Clerk of the Superior Court of said County.
