In the name of God Amen. This second day of January seventeen hundred and ninety six I, Simeon Spruill of Tyrrell County & state of North Carolina planter being very sick & weak but of perfect mind & memory thanks be given to God, therefore calling to mind the mortality of my body & knowing that it is appointed for all men once to die, first of all I recommend my soul into the hands of God that gave it & my body to the earth to be buried in a decent Christian burial at the discretion of my executors, and as touching such worldly estate as it hath pleased God to bless me with in this life I dispose of in the manner and form following, Imprimis. I give will and bequeath to my beloved son Hezekiah Spruill the plantation whereon I now live with land belonging to the same containing one hundred and forty acres be the same more or less, bounded beginning at a sweet gum on the edge of the swamp and running along a line of marked trees to the back line of my land to a beach in Josiah Collins' line then binding on his line to John Ansley's line then on the line of Solomon Ansley's land as was to John Ansley's and then on his line to the first station to him his heirs and assigns forever Item I give will and bequeath to my beloved grandson Simeon Spruill the plantation whereon my son Edward Spruill lived with sixty acres of land be the same more or less beginning at a sweet gum my son Hezekiah Spruill's corner runing along the said line of marked trees to Josiah Collins's line to a beach corner my son's then binding Collins' line to John Bateman's then binding on sd Bateman's line and other to the first station but if he shall decease before he arrives to the age of twenty one years or without an lawfull heir begotten of his body then to be equally among my children divided their heirs & assigns forever Item I give will and bequeath unto my beloved children Joanna Tarkinton Sarah Spruill Mary Spruill Hezekiah Spruill & Zilfah Spruill all the remaining part of my estate to be equally amongst them their heirs & assigns forever. Lastly I make will constituate and ordain my beloved friend Capt. John Ansley & my beloved son in law Zebulun Tarkinton my whole and sole executors of this my last will and testament disannulling all other wills in any ways before named ratifying & confirming this and no other to be my last will & testament & in witness whereof I have here unto set & put my hand and seal the day and date above written

Ordered that Zebulon Tarkenton be appointed guardian to Zilpha Spruill orphan of Simeon Spruill Esqr. deceased and give bond & security in 1,000 pounds John Bateman & Joseph Ansley Junr. securities.
July Session 1799
Ordered that Zebulon Tarkenton be appointed guardian to Hezekiah Spruill orphan of Simeon Spruill deceased and give bond & security in 2,000 pounds John Frasier & Isaac Patrick securities.

Spruill, Simeon, 1796
Division of part of the estate of Simeon Spruill Esqr. on 3 Feb 1796 to Joanna Tarkenton, Sarah Spruill, Mary Spruill, Hezekiah Spruill & Zilpah Spruill. Negro man named Tom and negro woman named Nina to Joanna Tarkinton. Two negro girls named Nonas & Rose to Sarah Spruill. A negro man name Moses to Mary Spruill. A negro man named Myles to Hezekiah Spruill. A negro boy named Bobb and a negro girl named Huldah to Zilpah Spruill.
Petition of Samuel Spruill in April Term 1797 complaining that his father Joseph Spruill deceased and his uncle Simeon Spruill deceased possessed a negro woman named Dinah and her increase, now amounting to four, as tenants in common. Said negro woman remained in the possession of Simeon Spruill during his lifetime and now his executors refuse to make appropriate division.
