I Charles Spruill of the County aforesaid being very sick and low in flesh but in perfect sound mind & memory tanks be to God for the same do make and ordain this to be my last will & testament in manner following to wit:

First of all I resign my soul into the hands of Almighty God who gave it and my body to be buried in a Christian like manner at the discretion of my executors hereafter named.

I give and bequeath to my wife Mary Spruill the following negroes Viz: Lewis Daniel Fed Aft Alpred Black Nell George Big Belt Margaret Matilda one bay mare Chair & harness which Chair and harness she has in her possession also one third part of all my stock all furniture that she was possessed of when she come from Pungo also all the land and swamp that was hers lying on Pungo Creek Hyde County provided that the sd. Mary Spruill makes no fast demands on any of other lands acoda to former bargin.

I give & bequeath to Mary Anne England one negro woman by the name of Yellow Nell all the hogs that was called hers when she came to my house also two ews & lambs one cow called Daphne and her yearling also on third part of my manner plantation & woodland thereunto joining for & during her natural life or widdowhood.

I give & bequeath to my sister Elizabeth Cullipher five hundred dollars to be paid out of my estate.

I give & bequeath to Joanne Armstrong five hundred dollars.

I give & bequeath Zilpha Davenport five hundred dollars.

I give & bequeath to my brother Benjamin Spruill in trust for my sister Mary F. Spruill five hundred dollars.

I give & bequeath to the heirs of Josiah Spruill Viz: that is to say Uriah Spruill five hundred dollars likewise to Pheriba Spruill two hundred dollars.

I give to the heirs of Wm. Spruill that is to say Hesekiah Spruill five hundred dollars also Frederic Spruill five hundred dollars also to Sally Hatfield five hundred dollars to Fanny Phelps two hundred and fifty dollars.

My will and desire is that my other estate both real & personal except negro wench Rachael be sold at the discretion of my executors & the money arising therefrom to be equally divided among my other heirs not heretofore mentioned. I give my negro woman Rachael her freedom to be placed under the governship of my brother Benj. Spruill. I hereby nominate and apoint Benj. Spruill Ebenezer Pettigrew & Lonard Martin my sole executors to this my last will & testament disanuling & revoking all others but this to be my last will & testament in witness I have hereunto set my hd. & seal this 14th day of December in the year of our Lord 1814. Codicil: My will and desire the one third part of my manner plantation heretofore given to Mary Anne England should by any means be taken from her so that she cannot posses the same my desire is that she should have ten acres of land in any part of my Culipher Plantation & a convenient house to be built thereon for her during her natural life or widdowhood at the discretion of my executors this a codicil to this my last will & testament witness my hand & seal this 14th day of Decmr. 1814 Sealed in presence of us.

January Session 1815

The death of Col. Charles Spruill former clerk being suggested James Hoskins came into open court & was unanimously appointed clerk for the County of Tyrrell and quallified agreeable to law & he entered into bond as the law directs & has given for security Robert Wynne & Jesse Alexander.

The last will & testament of Col. Charles Spruill was proved in open court by the oath of Jas. Wood & Daniel Bateman filed.

Mrs. Mary Spruill widow of the late Colo. Charles Spruill deceased appeared in open court and dissented from the will of said Chas. Spruill.

Ordered that the executors of Charles Spruill deceased have leave to sell the estate of said deceased agreeable to his last will & testament , and make returns to next court.

April Session 1815

Leonard Martin Esquire came into open court and was qualified as one of the executors of Colo. Charles Spruill deceased.

Solomon Hassell Esqr. returned into court the dower in land and a dividend of the estate of Colo. Charles Spruill deceased set off and allotted to Mrs. Mary Spruill widow of the said Charles Spruill deceased.

An inventory of the estate of Charles Spruill deceased was returned into court by Benjamin Spruill one of the executors of said deceased.

An account of sales of the estate of Colo. Charles Spruill deceased was returned into court by Benjamin Spruill Esqr. one of his executors to amount of two thousand six hundred and eighty dollars & 75/100 - - ? the widows legacies.

July Session 1817

Ordered by the court that Col Jesse Alexander James Woods and James Hoskins be appointed to audite & settle the estate of Charles Spruill deceased & make returns to next court.

October Session 1817

Ordered that Col. Jesse Alexander Samuel Spruill and James Hoskins be appointed to audite & settle the estate of Charles Spruill deceased & make returns to next court.

January Session 1818

Ordered that James Hoskins Samuel Spruill & James Wood or any two of them be appointed to audite & settle the estate of Chas. Spruill deceased & make return to next term.

April Session 1818

An inventory of part of the estate of Chas. Spruill deceased was returned to court on oath by Benjn. Spruill & filed.

Ordered that James Hoskins Samuel Spruill & James Wood or any two of them be appointed to audite & settle the estate of Col. Charles Spruill deceased and make return to the next term.

January Session 1819

Ordered that Levi Bateman Samuel Spruill & James Wood be appointed to audite & settle the estate of Chas. Spruill deceased with his executors & make return to the next term.

April Session 1819

Ordered that Benjn. Spruill executor to the estate of Chas. Spruill be allowed the sum of $132.25/100 for expense settling said estate as past filed.

An inventory of part of the estate of Chas. Spruill deceased was returned to court on oath by Benjn. Spruill & filed.

Ordered that the land of Col. Charles Spruill deceased which was sold by the executors & bid off by James Wood the sale be void as said land was afterwards sold again by the said executors of said deceased & that the latter sale stand good - - also the land purchased by Benjn. Spruill called the Sailor Joe Tract.

Ordered that Samuel Spruill Levi Bateman & James Wood be reappointed to audite & setle the estate of Charles Spruill deceased & make return to next term.

July Session 1819

Ordered that Samuel Spruill James Wood & Levi Bateman be appointed to audite & settle the estate of Charles Spruill deceased with the executors of said deceased & make report to the next term.

October Session 1819

Ordered that Samuel Spruill Levi Bateman & James Wood be reappointed to audite & settle the estate of Charles Spruill deceased with his executors & make report to next term.

January Session 1820

Ordered that Samuel Spruill James Wood & Wilson B. Hodges or any two of them be appointed to audite & settle the estate of Charles Spruill deceased with his executors & make report to the next term.

April Session 1820

Ordered that Benjamin Spruill be allowed the sum of fifty dollars & sixty two cents to be paid him out of the estate of Charles Spruill deceased for selling the estate of Jose Spruill deceased to whom the said Charles Spruill deceased was administrator.

Report of auditors on the estate of Charles Spruill deceased was returned to court & filed.

Spruill, Charles, 1815


Deed dated 5 May 1816 in which Benjamin Spruill of Tyrrell County and Leonard Martin of Pasquotank County, executors of Charles Spruill deceased sell to Jesse Alexander Esqr. for $415 a 50 acre tract of land on the west side of Scuppernong River. Boundaries mentioned are the Bear Cabbin Ridge, Davenport's line, the dividing line made between Joseph Spruill Senr. and his son Thomas Spruill, the dividing line that was formerly between Joseph Spruil Senr. and Jesse Hatfield and a line formerly between Joseph Spruill Senr. and Isaac Davenport. Witnessed by J. Wood & Uriah Spruill.

This file contains many documents relating to suits filed by and against the estate for recovery of debt. They appear to have no genealogical value. One suit concerns an allegation that Charles Spruill, former Clerk of Court for Tyrrell County, maliciously issued several executions that had not been ordered by the Court.


Transcriber's Notes:
Tyrrell County marriage bonds show the marriage of Joannah Spruill to Andrew Armstrong on 20 Dec 1787, John Rogers security; also Zilpa Spruill to John Davenport on 4 Aug 1782, Jos. Wyatt & Thos. Warrington securities; also Fanny Spruill to Jeremiah Phelps on 24 Jul 1808, Nathan Spruill security; also Mary England to Harman Bateman on 22 May 1816, John Ansley security.

It appears from this will that Charles Spruill married Mary England, a widow from Hyde County who had a daughter Mary Anne England who married Harman Bateman in 1816. It also appears that Charles Spruill had no children of his own and that all the legatees in this will, other than his wife and stepdaughter, are siblings. Indicators of this are that the administrator of Josiah Spruill's estate was Charles Spruill Junr. and that Joanne Armstrong and Zilpha Davenport are shown to be Spruills by the marriage records above.
