In the name of God amen: I James Swain of the County of Tyrrell and State of North Carolina, being weak of body, but of sound mind and perfect memory, thanks be to God, calling to mind the uncertainty of life and knowing that it is appointed unto all men once to die, do make and ordain this instrument as my last Will and Testament. In the first place I assign my soul into the hands of God who gave it and my body to the dust to be buried a decent Christian like manner, and as touching what little earthly goods it has pleased God to bless me with, it is my will and desire that it be disposed of in the following manner to wit.

Item - I lend unto my beloved wife Edny Swain during her natural life or widowhood, all my negroes, stocks of all kinds, goods and chattles, of every discrption and after raising sufficient sum to pay all my just debts.

Item - It is my wish and desire that after the death or marriage of my Edny, that an equal division of all my negroes, stock of all kinds, goods and chattls of every discription, take place between my three children, namely Daniel, Marian Ann and William Swain. In witness whereof I hereunto set my hand and seal this Ictober 22 1835 ---

The last will and testament of James Swain was exhibited in open court & proved by the oath of Wm. Mann who swore at the time of signing the same he was of sound and disposing mind and memory.
