In the name of God I Abigail Swain of the County of
Tyrrll and State of North Carolina being of sound disposing mind do make and ordain this to be my last will and testament
in the manner and form following - After my death my boddey deacently buryed my burial expences pade and
one set of toom stones seting fourth one at my head & the other to my foot
with my age and dath allso one set of toombs to my dear beloved father allso one
set of toombs to my mother also one set of tooms to my (blank) Allso one set of
toombs to my sister Nancy Basnet seting fourth to be there ages & death on
them toombs - One negro boy Tom to be sold at three month six month
& nine month credit-
1 - I give and bequeth to my sister Polley one dollar
2th - I give and bequeath to my brother Timothy forty dollars also I give to
his daute Frances ten dollars
3 - I give and bequeth to my brother Uriah Decd. this dauter M.
Elizabeth sixteen dollars
4 - I give and bequeth to my sister Farebee 1 bed & furniture
5 - I give & bequeth to my sister Marthey 1 chest
After all my onest debts is settled the balance of my money & nots to be eqley devid
between my two youngest sisters Marthey & Farebee
And lastly I do hereby constitute and appoint my friend Timothy Swain & J. W.
Hassell my lawful executors to all intents and purposes to execute this my
last Will and Testament acording to the true intent and meaning of the same
and every part and claus thereof hereby revoking and declaring utterly
void all other Wills and Testaments by me heareto fore made in Witness whereof I
the said Abigial Swain do hereunto set my hand and seal this the 29th
day of October A. D. 1848
Signed sealed published and declared by the said
Abigail Swain to be her last Will and Testament in the presence us who
at her request and in her presence do subscribe our names as witness thereto.

N. Carolina Tyrrel County Then was this paper writing exhibited in open court purporting to be the last
Will & Testament of Abagail Swain decd by Timothy Swain &
proved by the oath of Jacob Swain a subscribing witness thereto who swore
that he saw said Abagail Swain sign seal & deliver said writing to be
& contain her last will & testament that at the time thereof she was of
sound disposing mind & memory & that she did it freely & of
her own accord whereupon Timothy Swain qualified as executor thereto
ordered that this paper writing with this probate be recorded.
