Undated petition in the Superior Court by Prisey Bodwell against Lemuel Basnight executor and guardian to Cora E. Combs, Lola O. Basnight & Lemuel Combs. Plaintiff shows that Robert Sawyer died intestate leaving surviving him your petitioner, Gillie, Patsey, Pherebee, Peleage & Olly Sawyer, his children and only heirs at law upon whom his real estate descended equally in six shares. At the time of his death, Robert Sawyer was seized in fee simple of a tract of 200 acres on the west side of Great Alligator River, it being half of Anthony Ward's patent number 71. There is also another tract of 10 acres adjoining this tract. Plaintiffs further show that they desire to have partition made amongst plaintiff and defendants according to their respective rights and intents thereon but owing to the size of the tract, the number of parties interested, the nature and quality of the soil and other causes, it is impossible that partition thereof can be made without serious injury to all concerned. Petitioners therefore pray a court order to sell said land so that the proceeds may be divided among them according to their respective shares and that said land be secured for them according to law. Petitioner is entitled to one moiety or half of said land and defendants are entitled to one half or moiety of the same. Defendants have been in possession of said land for a long time running and enjoying the rents and profits of the same and cutting the timber, the value of which is $1,000 or some large amount. Petitioners pray an order for the sale of said land be issued, the proceeds be divided according to their respective interests and that plaintiffs can have an account of said rents and profits judged againt the defendants. [Based on following summons, date was 1872/1873.]
