Dated 6 July 1895
I Levi N. Tarkenton of the county of Tyrrell and state of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last Will and Testament in manner and form following: that is to day:- First that my executors hereinafter named shall provide for my body a decent burial. And pay all funeral expences, together with my Just debts howsoever and to whomsoever owning out of the moneys that may first come into their hands as a part or parcel of my estate.
Item: I give and devise to my son Joseph R. Tarkenton one dollar in value of my real estate, and one seventh part in net value of my personal estate except my blacksmith shop tools (which will hereafter more fully appear in this instrument) in satisfaction and in Lieu of all other interest he might otherwise have inherited in my estate at the time of my death.
Item : I give and devise to my son Mathias L. Tarkenton one dollar in net value of all my real estate, and one seventh part in net value of all my personal estate (except above mentioned shop tools) in satisfaction and in Lieu of all other interest he might, otherwise have inherited in my estate at the time of my death.
Item: I give and devise to my five other children Viz: Dorcas Langley, Allice Thomas, John Tarkenton, Edward Tarkenton and Warren Tarkenton, the remainder of my estate (except shop tools) both real and personal that may be in my possession at the time of any death in net Value, to be equally divided between the five named children by any Executors hereinafter named.
Item: I give and devise to my son Edward Tarkenton all my blacksmith shop tools in addition to above described property.
And lastly, I do hereby constitute and appoint my esteemed Friends John H. Thomas and Thos. W Swain sole executors of this my last Will and Testament hereby revoking and making void all and every other will or wills at any time heretofore made by me and do declare this to be my last will and testament. In witness whereof I the said Levi N.Tarkenton have hereunto set my hand this 6th day of July 1895.

In the Superior Court
A paper purporting to be the last will and testament of Levi N. Tarkenton deceased, is exhibited before me the undersigned, Clerk of the Superior Court for said County by T. W. Swain and J. H. Thomas the executors therein mentioned and the due execution thereof by the said Levi N. Tarkenton by the oath and examination of T. W. Swain and J. K. P. Owens the subscribing witnesses thereto, who being duly sworn, doth depose and say and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him purporting to be the last Will and Testament of Levi N. Tarkenton that the said Levi N. Tarkenton in the presence of the deponent subscribed his name at the end of a paper writing which is now shown as aforesaid and which bears date of the sixth day of July 1895. And the deponent further saith, that the said Levi N. Tarkenton the testator aforesaid, at the time of subscribing his name as aforesaid declare the said paper writing so subscribed by him and exhibted to be his last will and Testament, and this deponent did thereupon subscribed his name at the end of said will, as an attesting witness thereto and at the request and in the presence of said Testator. and this deponent further saith, subscribed his name to the said last will as aforesaid and at the time of the deponents subscribing his name as an attesting witness thereto, as aforesaid, the said Levi N. Tarkenton was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent: And further these deponents say not.
