Dated 20 June 1754


In the name of God amen: The twenteth day of June in the year of our Lord one thousand seven hundred and fifty four I Joshua Turner of Scuppernong in the County of Tyrrel in North Carolina being sick and weak but of perfect mind and memory thanks be to God Therefore calling to remembrance the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament: that is to say principally and first of all I give and recommend my soul into the hands of God and my body I recommend to the Earth to be buried in deceant Christain burial at the discretion of my Executors nothing doubting but att the General Resurection I shall receive the same again by the mighty Power of God and as Touching my Worldly Estate where with it hath pleased God to bless me in this life I give demise and dispose of the same in the following manner and form---

Imprimas - I give and bequeath unto Jesse Lewes the plantation whereon I now live with the land thereunto belonging to him and his heirs and assigns for ever together with all my house hold goods and moveable effects that I am possessed with at my death--

And I do here appoint my trusty and well beloved frind Joseph Spruill the son of Samll Spruill Senr. Trustee for the said Jesse Lewes to sell and make bargains for the said Jesse until the said Jesse comes to the age of eighteen years and to receive and pay all debts that shall appear to be dew and to apply some of the said money for the use of the said Jesses learning: I also constitute make ordain and appoint Jesse Lewes my Executor and Ann Lewes my Executrix of this my last Will and Testament I do hereby utterly disallow revoke and disanull all and every other Testaments Wills Legacys and bequeaths and Executors by me in any ways before named willed and bequeathed rattifying and confirming this and no others to be my last Will and Testament. In witness whereof I have hereunto set my hand and seal the day and year first above written.

In the time of June 1755 this will was duly proved by the oath of Jeremiah Spruill a subscribing witness hereunto who on his oath saith that Joshua Turner was of sound mind & disposing memory and at the same time Godfree Spruill & Mary Spruill signed as witnesses ordered that the secretary issue letters testamentary according to law

March Session 1755

The last will and testament of Joshua Turner was exhibeted in open court & proved by the oath of Nehemiah Spruell one of the subscribing witnesses thereto and Mary Ganner/Garner qualified as executrix of said will.

December Session 1755

Alexander McCeeb is appointed guardian of Elizabeth Lewis, Thomas Lewis, Joshua Lewis and Jesse Lewis orphans of Thos. Lewis late of this county deceased, that Jacob Blount & John Hardison security. And it is by this court ordered that the said Alexander McCabe take into his hands and possission all the goods and chattles found and that Henry Garnar deliver the estate of Thos. Lewis and Joshua Turner that is in his possion to the said Alexander McCeeb and that the said Alexander McCeeb return a copy of his proceedings to next court.

March Session 1756

Alexander McCead came into court and proved the estate of Thomas Lewis and Joshua Turner.

December Session 1756

On motion of Mr, Jonston ordered that Alexander McCabe redeliver to Ann Garner executrix of Joshua Turner the estate of the sd. Turner whivh was formerly taken fom her by an order from this court and given into the care of the sd. McCabe and that the said Alexr. McCabe return to the next court an account of his proceedings of the said estate.

March Session 1757

Alexander McCabe exhibited his accts. against the estate of Joshua Turner. Ordered that the same be allowed the balance of 6 pence and proved the same on oath accts. as forsd.
