In the name of God Amen: I Devotion Twidy of the County of Tyrell and State of North Carolina who am weak and low in body but of sound mind and memory domake this my last will and testament and first I say and recommend my soul to God who gave it my body to be buried in a Christian like manner at the discretion of my executors hereafter mentioned and what worldly godds it hath pleased God to bless me with in this life I dispose of in the following manner.

I lend to my beloved wife Anne Twidy 50 acres of land to be laid of so as to take the house in which I now live in during her natural life also one bed and furniture four cows and calves one yoke of steers.

I give to my seven sons James Isaac Devotion Davy Daves Thomas Benjamin Jackson all my lands in Tyrell County except 50 acres will be hereafter bequeathed to my sister Meriom Basnet all the rest of my lands to be equally divided among my seven sons agreeable to quantity & quality to them their heirs and assigns forever & in case of either of my sons dies before they have lawful heir their part to be equally divided among my living sons. I give to my son James One mair cald. Bead one cow & calf to him and his heirs forever. I give to each of my daughters Sally Milly & Polly Twidy each one bed & furniture to them & their heirs. The land that I have to my sister is one the west side of my survey to her & her heirs lawfully begotten of her body.

My will is that my wife have the use of all the ballance of my property during her life or widdowhood to raise my children on. I give to this child that my wife go with if it should be raised to the age of maturity that is to say six cows and calves and at my wifes death or marriage all the ballance of my cattle not given to be equally divided among my three daughters all the ballance of my property at the dath or marriage of my wife to be equally divided amonst seven of my children if this my wife goeth with that is to say Sally Milly Davis Thomas Polly & Benjamin Twidy to them & their heirs forever.

My will is that my father John Twidy livet in and haveth maintainance out of my estate as long as he should live unmolested by any person ---

I hereby appoint my wife Anne Twidy and brother James Owens and Joshua Swain my lawfull executrix and excutors of this my last will and testametn in witness whereof I have hereunto set my hand this twentieth day of February one thousand eight hundred and fourteen.

Court of Pleas Quarter Session Octr. Term 1814. Charles Alexander came into open court and being duly sworn deporteth that he saw Devotion Twidy sign seal publish and declare this instrument of writing to be his last will and testament and that he was at the time of publishing sound perfect mind & memory & that he also saw Wm. Mydgitt & Margrey Owens sign the same as concerning evidence thereto.

October Session 1814

The last will & testament of Devotion Tweedy was proved in open court by the oath of Cornelus Alexander & filed.

Ann Tweedy came into open court & quallified executrix to the last will & testament of Devotion Tweedy in due form of law.

July Session 1815

Inventory of the estate of Devotion Twedy was returned into court by Ann Twedy his executrix.

January Session 1823

A plat and division of the lands of Devotion Tweedy deceased was returned to court & ordered to be registered.

Twiddy, Devotion, 1822


Petition October Term 1822 by James Twiddy Isaac Twiddy and John Twiddy who state that their father Devotion Twiddy made his will in due form of law and devised to your petitioners and Devotion, Davis, Thomas and Joshua Twiddy infants two tracts of land containing four hundred acres, one adjoining John Roughton and the other adjoining Nathan Twiddy. The will of Devotion Twiddy stipulated these lands be divided equally among your petitioners and they pray a commission be appointed to make the division.


Transcriber's Notes:
The above will says there are seven sons, but eight are named. The petition in estate papers names seven sons, some different than those named in the will. This will was transcribed from a type-written copy in a will book, not the original will. The petition is extracted from an original document. I would therefore place more faith in the sons listed in the petition.
