Dated 9 Mar 1849

I Joseph Wynne of the county of Tyrrel & State of North Carolina do make this my last Will & Testament this 9th day of March 1849-

First- I leave unto Mary Elizabeth Hatfield during her natural life negro man Devy & negro woman Amris and after death I give them and the increase to her children if any living.

2d. I also loan unto Levi W. Hassell negro man Spencer & woman Dophne during his life them with the increase to go his children if any child or children then living-

3d. All the land I own at my death I direct to be sold & the interest of the same to be paid over anually & equally unto said Mary and said Levi. and at the death of either one half to be paid over to his or her child or children if any then living, and so at the death of the other, the other half to be paid to his or her child or children if any then living-

4th. The residue of my property shall be sold at six months credit & of the proceeds thereof I give to Joseph Wynne Etheridge son of Asa Etheridge two hundred dollars-

5th- Out of the same fund I give unto Joseph Wynne Brickhouse son of Hardy T. Brickhouse two hundred dollars-

6th- Out of the same fund I give unto Joseph Wynne Patrick son of Fred K. Patrick two hundred dollars, these three amounts to be kept at interest by my exr. Or exect. Until the children aforesaid severally attain to twenty one years of age.

7th. The residue of my estate, or funds if any I give to my nearest blood kin living at my death.

8th. I give unto my three executors whom I nominate & appoint as follows to Wm. Wynne, James F. Davenport & Robert R. Heath or to whoever of them shall qualify four hundred and fifty dollars in full of all services, and which is a charge on my estate generally- Signed witnessed and declared to be Jos. Wynn's last Will & Testament revoking all others the day & year aforesaid

October Term 1849

The next of kin being in court & not objecting a paper writing pertaining to be the last Will & Testament of Jos. Wynne decd is produced in open court & the due & formal execution as a Will & Testament is proved by Jordan L. Jones & Jos. Mclees subscribing witnesses theto who swore that they saw said Wynne sign said paper writing and heard him declair the same to be his last Will & Testament that he was of sound & disposing mind & memory at the time & they at the same time signed the said paper writing as witnesses in his said Wynne presence & at his request let it be admitted to probate & the same is hereby admitted to probate as a will passing realty & personalty at the same time James F. Davenport & R. R. Heath two of the excrs therein named appeared & qualified thereto the other exer declining to qualify-
