In the name of God Amen. This twenty eight day of November one thousand seven hundred and ninety six I John Wynne planter of the county Tyrrell being sick in body but of a sound and perfect memory thanks be to almighty God calling to mind the uncertain state of this transitory life and that all flesh must yeild unto death when it please God to call do make constitute ordain & declare this my last will and testament in the manner & form following revoking and annulling by these presents all & every will or wills by me made either by word or riting and this onely is to be taken for my last will & testament & none other - -

Item I give and bequeath to my well beloved son Jeremiah Wynne his heirs and assigns for ever one certain tract or parcel of land where on he now lives containing one hundred and eighteen & half acres of land also a negro woman named Rachel & two cows and calves to be delivered next spring issuing out of my estate one weeding plow & one horse cart & harness - - -

Item I give & bequeath unto my well beloved daughter Mary Garrett her heirs & assigns for ever one negro woman named Pat one negro girl named Chana -

Item I give & bequeath unto my well beloved daughter Jemima Garrett her heirs and assigns for ever one negro woman named Nanc one negro girl named Peninah -

Item I give and bequeath to my well beloved son John Wynne his heirs and assigns for ever one certain tract or parcel of land lying in the county of Tyrrell between Scuppernong River and Great Allagator River where on my stock is now kept containing three hundred and thirty three acres of lands two cows and calves one horse called Siras one new sadle & bridle one bed & furniture one chest one negro boy calld David one negro boy named Charles also twenty five pounds spec to be paid out of my estate to get him scoold - -

Item I give & bequeath unto my well beloved daughter Sarah Wynne her heirs and assigns for ever two beds & furniture one negro boy calld Mac one girl calld Ails one mahogney table one hunting sadle one bridle and one bible also ten pounds to get her scoold - -

Item I lend to my well beloved wife Anna Wynne dureing here natural life or widdow hood the mannar plantation where on I now live with all the land beloning or joining the same also one negro woman named Nance one negro woman named Edea & Lewis & Will my new flat my little padling cunoe two bars plow two weeding plows hows & axis one yoke of oxen & two carts one horse named Buck and all the cattle at this mannar plantation six heaffers to be brought from stock from Alagator also three pots one tea kittle & little small pot one little ? one dutch oven one frying pan four tubs and all the ? thing in the milk house two soap tubs in the smoke house three neat ? one hoghead one sythe all the flax & all the provisions of all kind all the cask in the new barn one grass sythe all the hogs on the land two tables all the old cheers the black walnut chess three chist one cherreetree desk four beds & furniture one safe and all the crokry ware belonging to it all the pewter in the house one pine joining table one tongs one sheefell one pr. fire dogs one pr. do. also all the sheep on the plantation four baskitts also forty pounds spec to purchase corn for the use of my family one hand mill all the geers & stays one ox yoke and chair two sets of horse ? - -

Item I give and bequeath unto my well beloved son William Wynne his heirs and assigns for ever one half the plantation whare on I now lives one half the buildings on the same and one half the land belonging to the same one bed and furniture one chest one table forty pounds spec to get him scoold also one equal half of a negro boy calld Will one equal half of a negro woman called Edea and one equal half of the increase - -

Item I give and bequeath unto my well beloved son Tully Wynne his heirs and assigns for ever one half the the plantation whare on I now lives one half the buildings on the plantation and one half the land belonging to the same forty pounds spec to get him scoold also one equal half of a negro boy calld Will one equal half of a negro woman called Edea and one equal half of the increase one chest one table one bed & furniture - -

Item Either William Wynne or Tully Wynne decsd before the sd William arrive to the age of twenty one years I give and bequeath the hole of his leggisiss to Tully Wynne if Tully decd before he arrives to the age of twenty one I give all his legassis to William Wynne if William & Tully Wynne decsd before either of them arises to the age of twenty one years old I give and bequeath the manner plantation whare on I now lives to my well beloved son John Wynne his heirs and assigns for ever and all the land belonging to the same - -

Item I do hereby impower my executors to sell at publick sale a certain woman named Mol a certain negro woman named Dinah also two ? of lots in Elizabethtown also one hundred acres of lands lying up Mill Tail Creek & I do hereby impower Robert Wynne to give warrantee deeds for the afore sd lands also also to give warranteee bills of sails for two negros above named and I hereby impower Robert Wynne to make and ? ? for the same & do oblige my heirs & assigns to abide by the proceeding - -

Item I leave all the remaining parts of my estate to be sold at publick vandue by executors here after named & out of the same I desire that the sd exeutors pay all my just debts - -

I do hereby apoint Robert Wynne & my well beloved wife Anna Wynne & my well beloved son Jeremiah Wynne to be my soul executors & executrix of this my last will and testament - -

Item I do hereby impower my executors to go across the sound to James Summers & procure the title of a certain negro woman named Nance wich I have now in my possession wich I purchased of William Clayton wich if my executors can purchase the title of the sd Sumers for twenty pounds currency to do it and take a bill sail to the leaving part of my estate - -

All the remaining part of my estate after the decease of my wife I equally divide amongst my childern Jeremiah Wynne Mary Garrett Jemima Garrett John Wynne Sarah Wynne William Wynne & Tully Wynne their heirs and assigns for ever in witness whare of I the said John Wynne have hereunto set my hand and seal day & date before ritten

October Session 1817

Ordered that the young negroes belonging to the estate of John Wynne deceased be divided between William & Tully Wynne & that James Hoskins James Wood & Richd. Wood be appointed to divide the same & make return to next term.

July Session 1818

Division of negroes agreeable to the last will and testament of Jno. Wynn deceased was made by mutual consent by the parties in 1817 and filed in this court by James Hoskins.

Bond dated 27 Oct 1797 in the amount of one thousand pounds appointing Ann Wynne guardian of William Wynne orphan of John Wynne deceased, James Hoskins & Joseph Wynne securities.

Bond dated 27 Oct 1797 in the amount of one thousand pounds appointing Ann Wynne guardian of Tully Wynne orphan of John Wynne deceased, James Hoskins & Joseph Wynne securities.

Bond dated 31 May 1798 in the amount of five hundred pounds wherein Ann Wynne guardian is bound to pay a proportional share of any claims against the estate of John Wynne deceased after having received a distribution of said estate for William & Tully Wynne per the will of John Wynne. Distribution was eighty pounds, negro woman Edie, negro boy Will, two beds and furniture, two tables and two chests. James Hoskins was security.

Bond dated 17 May 1799 in the amount of two hundred and eighty dollars wherein Ann Wynne guardian is bound to pay a proportional share of any claims against the estate of John Wynne deceased after having received a distribution of said estate per the will of John Wynne. Distribution was sixty seven pounds & thirteen shillings & two pence. James Hoskins & James Dillin were security.

Bond dated 28 Jan 1800 in the amount of five hundred dollars wherein William Garrett is bound to pay a proportional share of any claims against the estate of John Wynne deceased after having received a distribution of said estate per the will of John Wynne. Distribution was one negro woman named Nane, one negro girl named Pennah, and thirty three pounds & sixteen shillings & seven pence three farthings. Ezekiel Hardison & Martin R. Byrd were security.

Bond dated 26 Oct 1800 in the amount of five hundred pounds wherein John Wynne is bound to pay a proportional share of any claims against the estate of John Wynne deceased after having received a distribution of said estate per the will of John Wynne. Distribution was one negro boy named Charles, one negro boy named David, two cows and calves, one horse, one saddle and bridle, one bed and furniture, one chest and thirty three pounds, sixteen shillings and seven pence three farthings. Joseph Wynne & Moses E. Cator were security.

Bond dated 10 Feb 1803 in the amount of five hundred dollars wherein Ezekiel Hardison is bound to pay a proportional share of any claims against the estate of John Wynne deceased after having received a distribution of said estate. Distribution was a negro girl named Ails, a negro boy named Mack, one mahogany table, one saddle, one bridle and thirty three pounds sixteen shillings and seven pence three farthings. William Garrett was security.

Bond dated 24 Apr 1804 in the amount of five hundred dollars appointing Ann Wynne guardian of William Wynne & Tully Wynne orpans of John Wynne deceased, Jeremiah Wynne & James Hoskins Esqr. securities.

Tyrrell County marriage bonds show the marriage of J. Wynne to William Garrett on 27 Mar 1795, John Garrett security; also Mary Wynne to Joseph Garrett on 8 Jan 1792, Thomas Fagan security.
The marriage of Sarah Wynne to Ezekiel Hardison is implied by the bond he gave for the inheritance she is to recieve in the will.
