Will & Estate of Susan M. Fain-1881

A. E. HENDERSON being sworn doth say, that SUSAN M. FAIN, late of said County is dead leaving a will & testament herewith presented to be probated.  And said A. E. HENDERSON further says that he is the Executor named in said will. And he further says that said SUSAN M. FAIN, died signed of one tract of land lying near Williamsboro in said County, supposed to be worth about six hundred dollars; and Household and kitchen furniture & other personal property, suppposed to be worth about four hundred dollars.  And he further says that the following are the true names & residences of those entitled to testators property, to wit:

Nutbush Presbyterian Church in said County
Dr.Wm. F. Henderson in said County
Anna Haithcock in said County
A. E. Henderson in Caswell County
John L. Henderson in Montgomery, Ala
The Children of Dr. L. H. Hare in State of Mississippi
viz, Sallie S., Susan L, William B., Mary J., all of age
The Children of William & Agnes Hirt in State of Alabama;  viz, Mary, Susan & Willie, all supposed to be minors.
The Children of John L. Hare, in Washington, N.C., minors.
Julia Fain, in said County.
Dr. L. H. Hare & wife Mary
Mrs. Belle Bullock in said County
Mrs. Nannie Parham in said County
All of whom are entitled as heirs & distribution of said property.

A paper purporting to be the last will & testament of SUSAN M. FAIN, deceased, is exhibited before me the undersigned

Judge of Probate for said County, by A. E. HENDERSON, the Executor therein mentioned and the due execution thereof by the said SUSAN M. FAIN by the oath and examination of WALTER BULLOCK & MOLLIE A. KING, the subscribing witnesses thereof; who being duly sworn, doth depose & say, & each for himself deposeth & say that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will & Testament of SUSAN M. FAIN.  That the said SUSAN M. FAIN in the presence of these deponents subscribed her name at the end of said paper writing which is now shown as aforesaid and which bears date of 20th day of January 1881.
And the deponents further saith:
That the said SUSAN M. FAIN the testator aforesaid did at the time subscribing his name as aforesaid declare the said paper writing subscribed by him and exhibited to be her last will and testament, and this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereto and at the request and in the presence of the said testator.  And this deponent further saith that at the said time when the said testator subscribed his name to the said last will as aforesaid, and at the time of the deponents subscribing his name as an attesting witness thereto as aforesaid the said SUSAN M. FAIN was of sound mind and memory, of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent. And further these deponents say not.

Thereupon it was ordered that the said last Will and Testament of SUSAN M. FAIN, Deceased, be admitted herein and enrolled in the book of Wills and the original copy duly filed according to law. It being adjudged in due form & the proved added being according to law & worthy of full credit.

The Last Will and Testament of Susan M. Fain, Deceased

 
In the Name of God, Amen, I SUSAN M. FAIN of the County of Granville and State of North Carolina do make & ordain this my last will & testament, viz;
After paying certain specified legacies herein after to be specified, I give and bequeath to A. E. HENDERSON & JOHN L. HENDERSON, children of WM. F. HENDERSON & my late sister A. F. E. HENDERSON to them their heirs & assigns forever in fee simple half of all my estate real, personal & mixed, and in like manner to the children of my brother L. H. HARE, to them their heirs & assigns forever -- in fee simple.  I wish my Executor to apply ($50) fifty dollars of my Estate to the purchase & placing over my remains a marble slab.  To the Nutbush Presbyterian Church 50$ in fee simple and to WM. F. HENDERSON in fee simple fifty dollars (50$), likewise I bequeath to ANNA the wife of JOHN E. HAITHCOCK, in fee simple, my parlor center table.  
Likewise in fee simple, to R. A. BULLOCK my copy of Websters Unabridged Dictionary.
I direct that my solid silver ware be equally divided between A. E. HENDERSON & brother JOHN L. HENDERSON to whom I give & bequeath in fee simple one half of said solid.  The remaining half in like manner to the children of my brother L. H. HARE in fee simple to be equally divided among them to share & share alike.  I leave it discretionary with my Executor to dispose of my secretary & crib as he may think proper.  I wish JULIA FAIN to have a saw tooth bed quilt.  I give to my brother in fee simple my gold spectacles & in like manner my silver ones to his wife.  In like manner to BELLE the wife of R. A. BULLOCK the two pickle stands.  In like manner to NANNIE PARHAM my arm chair. In like manner I give & bequeath to A. E. HENDERSON the painting in the parlor.  In like manner my album with photographs to my brother's family; & I with it sent to them.  In like manner I give my plain gold ring & large jet breast pin to HANNA I. the daughter of JOHN & of HANNAH HARE.
In like manner I give my large bible to WM. B. son of my brother L. H. HARE.  In like mind I give & bequeath to A. E. HENDERSON the diploma of my late son, JOHN H. D. FAIN.  I hereby appoint A. E. HENDERSON Executor of this my last will & testament & I subscribe my name & affix my seal this 20th January 1881.
