The earliest marriages (of which there are no records) followed a 1669 law which said that the bride and groom, together with 3 or 4 neighbors, should go to the Governor or any member of the Council, and say their "vows" and receive a certificate which was supposed to be registered in the Precinct Register. As far as we know, there are none existing for Bertie County (which became a Precinct of Albemarle County in 1722).

Bonds

The "Act Concerning Marriages" passed by the General Aseembly of April, 1741, granted the power of performing marriage ceremonies to every clergyman of the Church of England and to all Justices of Peace as well. Permission from a local minister had to be granted to the Justice of Peace, though, before he could solemnize the marriage. Marriages by either required the publishing of banns or obtain a license.

• Groom's name
• Bondsman's name (in some cases there were more than one)
• Date the bond was filed
• Bride's name
• Name of County in which Bond is filed (usually the Bride's county)
• Signatures (or "marks") of groom and bondsmen. (Pay attention to spelling variants)
• Witness (usually the Clerk of County Court) also signed
• Infrequently there may be parental consent indicating parent's names

Bondsman

The bondsman or surety was to be "able and knowne." Often, this person was a brother or uncle to the bride, not necessarily a parent. The rich and established uncle was an excellent candidate for bondsman. The bondsman could be related to the groom, but probably, that situation would occur less often.

No money actually changed hands at the time the bond was issued. If the groom failed to complete the marriage, the bondsman would be liable for any legal damages. More importantly it provided legal protection for the woman if the man turned out to already have a wife!

License

Documents created:

• Marriage Bond
• License. The official would sign the back to show it had been performed
• Ledger. The Clerk copied some information from the bond and license, and this is often the only surviving part of the record. Parents of neither the bride nor groom were named nor was their age included.

Banns

From the Book of Common Prayer of the Church of England
First the Banns of all that are to be married together must be published in the Church three several Sundays, during the time of Morning Service, or of Evening Service (if there is no Morning Service) immediately after the second Lesson: the Curate sahing after the accustomed manner,
I Publish the Banns of Marriage between _________ and __________. If any of you know cause, or just impediment, why these two persons should not be joined together in holy Matrimony, ye are to declare it. This is the first/second or third time of asking.

Unfortunately there are rarely records of these banns.

Eventually other non-Anglican denominations were allowed to perform marriages.

He summarizes the law in effect in 1839 and provides some added information:

• No white person is permitted to marry an Indian, negro, mustee or mulatto, or any person of mixed blood, to the third generation
• All the personal propery that the wife has in possession at the time of the marriage is vested absolutely in the husband; and he is liable for all her debts, whether her property be sufficient to pay them or not
• The age of discretion is fixed at 14 years old in males, and twelve in females.If they marry younger, they may disagree to the marriage when they arrive at these respective ages, and it therefore becomes void to all intents and purpose. Or if one party only be under the age of consent, and the other of full age, the party of full age is bound and the infant is not.
  • 1872 law. Male age was raised to 16; female to 14 and required parental consent for under 18
• Relations of the 3rd degree, whether by consanguinity or affinity, may lawfully marry, but not nearer than the 3rd degree, counting, not from, but though the common ancestor, so that first cousins may lawfully marry, although the father and the mother of each party were reciprocally the brother and the sister of the parents of the other party.

What did this mean to your ancestor?

If they chose to publish banns, no Bond was made. Not everyone who posted a BOND actually got married, but most of them did, so it is fair to assume a marriage unless you have other evidence.

If I can't find a Bond, what then?

• DEEDS sometimes include the name of the wife. Fathers sometimes give their land to grandchildren (since giving it to the wife automatically means it becomes the husband's), so the record may say, "to my grandson, James Ruffin, son of my daughter, Mary"
• WILLS. Read all wills of your surname even if you don't see the specific first name of a daughter. Again, her father may give land to grandchildren, and indicate them as "son of my daughter, Mary".
