Justices of Richmond County Court. The petition of Isabella Nicholson, Mary G. Nicholson, Daniel B. Nicholson,
Administrator of Jane Nicholson, deceased, and Graham A. Nicholson , Adm'r of Neill Nicholson, dec'd, Haywood
Nicholson, dec'd, and of Isabella Nicholson, dec'd, Administrator de bonis non of Mrs. Flora McCallum, dec'd,
against John Wall, Jr., Adm'r of Caroline Wall [of Anson County, NC], who was one of the legatees of Alexander
Nicholson, dec'd, and Edward McCallum, Exec'r of Wm. McCallum [of Montgomery County, NC] who was the adm'r of
Flora McCallum, who was also one of the legatees of Alexander Nicholson, dec'd. Humbly complaining sheweth unto
your Worships:
1. That Alex. Nicholson late of Richmond County departed this life sometime in the Month of ... A.D. ... having
first made and published his last will and testament in writing in manner and form sufficient to pass his personal
property. April 22nd 1836 Issue Fayetteville Observer: Died at his residence in Richmond County, Alexander
Nicholson on the 3rd, aged 66. Marriage & Death Notices - 1816-1840 - Hubbard
2. That by said will and testament he gave to his wife Isabella Nicholson 2 Negroes, and the balance of his
personal property together with the increase of the Negroes after paying his debts were to be equally divided
among his children, Graham A. Nicholson, Mary G. Nicholson, Neill Nicholson, Haywood Nicholson, Isabella Nicholson,
John Nicholson, (the four last named are now dead, and Graham A. Nicholson is their adm'r), Flora McCallum,
intermarried [m.1839] with William McCallum (both of whom are now dead; the said William [d.1845] having survived
the said Flora [d.1841] and having administration on her estate, and the said Wm. having since died and having
left a last will and testament whereof he appointed Edward McCallum his executor), Caroline Wall, who
intermarried with John Wall, Jr., the said Caroline being now dead, and the said John Wall, Jr. being her
admin'r, and Jane Nicholson who intermarried with Daniel B. Nicholson, the said Jane being now dead, and the
said Daniel being her administrator.
June 16, 1841 Issue Fayetteville Observer: Died on the 2nd Mrs. Flora McCallum consort of William McCallum,
at her residence in Montgomery County, NC, aged 25. She was the daughter of Col. Nicholson. Marriage & Death

September 21, 1842 Issue Fayetteville Observer: Died in this County at Mrs. McPherson's, Mrs. Caroline E. Wall,
wife of Mr. John L. Wall of Anson County, daughter of Sheriff Nicholson, of Richmond County. She had been married

3. Your petitioner further sheweth unto your Worships that since the death of Alex. Nicholson, Sen'r, that
Haywood Nicholson departed this life intestate in the year of our Lord 1839 leaving his mother, Isabella
Nicholson, Sen'r, Neill Nicholson, Graham A. Nicholson, Isabella Nicholson, Jr., Wm. McCallum & Flora his wife,
John Wall & Caroline his wife, Daniel B. Nicholson and Jane his wife, Mary G. Nicholson, Graham A. Nicholson &
John Nicholson his next of kin and distributees and that John Nicholson departed this life intestate in the
year 1841 leaving his mother, Isabella Nicholson, Sr., Neill Nicholson, Mary G. Nicholson, Graham A. Nicholson,
Isabella Nicholson, Jr., Wm. McCallum & Flora his wife, John Wall & Caroline his wife & Daniel B. Nicholson &
Jane his wife his next of kin and distributees, and that Isabella Nicholson departed this life intestate in the
year ... leaving her mother, Isabella Nicholson, Sen'r, Graham A. Nicholson, Mary G. Nicholson, the children of
Neill Nicholson who take through G. A. Nicholson the administrator of Neill Nicholson, and the daughter of D. B.
Nicholson and Jane his wife, who takes through D. B. Nicholson the administrator of Jane Nicholson, dec'd,
her next of kin and distributees, neither Flora McCallum nor Caroline Wall being entitled to any part thereof,
having left no children them surviving.
4. Your petitioner Graham A. Nicholson further sheweth unto your Worships that he has purchased for a valuable
consideration all the shares and interest of Flora McCallum & Caroline Wall from Edward McCallum the executor of
William McCallum (the said William being the administrator of said Flora his wife) and from John Wall, Jr., the
adm'r of Caroline his wife, and now claims the benefit of said shares to his own separate end.
5. Your petitioners further sheweth unto your Worships that there has never been a division of said property
among the several legatees and distributees, and that they are now desirous of having the same divided according
to law. They therefore pray your Worships that Edward McCallum, the executor of William McCallum & John Wall,
the administrator of Caroline Wall, may be made parties defendants and compelled to answer and say whether they
have not for a valuable consider-ation sold and conveyed all their interest as the representatives of the said
William & Flora McCallum and of John and Caroline Wall in the several estates in which they were interested, to
the said Graham A. Nicholson, and that your Worships will appoint commissioners to allot & divide the said
estates to and among your petitioners according to their respective shares and interests; that your Worships
will grant such other and further relief as the nature of the case may require and to your Worships shall seem
meet and proper, and your petitioners as in duty bound will ever pray.
May it please your Worships to grant to your petitioners your States Writ of Subpoena directed to said Edward
McCallum, executor of William McCallum and to John Wall, Adm'r of Caroline Wall commanding them to be and appear
at our next Court of Pleas & Quarter Sessions to be held for the County of Richmond at the Court House in
Rockingham on the 3rd Monday in ..., and then to answer the several allegations set forth in this petition,
otherwise judgment will be entered against them pro confesso and a decree made Ex parte as to them. A. Little,

In pursuance of an Order issued from the Court of Pleas and Quarter Sessions of Richmond County at October Term
1846 we, the undersigned committee met at the late residence of Alexander Nicholson, deceased, and proceeded to
allot and devise the Negroes belonging to said estate according to the complainants' petition, and the several
interests in said estate, after being duly sworn, did allot in the following man-ner (to wit.). We ascertained
there were thirty-six negroes belonging to said estate which was conveyed by the will of the testator. The
agregate valuation of said negroes we appraised at $12,180.00. The estate share of each legatee in this first
division and in the division of the estates of Haywood Nicholson, John J. Nicholson and Isabella Nicholson, Jr.,
being as follows, $2,030.00. No 1. To Mrs. Isabella Nicholson, Aaon, a man valued at $700. She being entitled
only to an interest in the estates of Haywood, John & Isabella Nicholson, deceased, appraised at $676.67. No 2.
To G. A. Nicholson as adm'r of Neal Nicholson, dec'd, Anna and child Noah, valued at $575; Ben a boy, $500; Liza
a woman, $200; Charles a boy, $450 and Easter a girl, $400. No 3. To G. A. Nicholson in right of himself in right
of a conveyance from Edward McCallum, Executor of Wm. McCallum who was adm'r of Flora McCallum, dec'd. that was
one of the legatees of Alexander Nicholson, dec'd and in right of a conveyance from John Wall, Adm'r of Caroline
Wall who was one of the legatees of said Nicholson, dec'd. Anna, a woman valued at $475; Calvin, a boy $600;
Harriet $250; Polly $175; Alfred $600; Judah and two children $675; Clary & Lot her husband $400; Emeline $325;
Mahala $200; Ann & Jannet $225; William $450; Hannah $450; Eady $200 & Daniel $200. No 4. To D. B. Nicholson,
Adm'r of Jain Nicholson, deceased, and guardian of Flora Nicholson, Julia valued at $475; Mat $525; Daniel $425;
Moriah $375; & Sarah $300. No 5. To Mary G. Nicholson, Willis, valued at $500, Betsy $450, Martha $375, Sal $5,
Frank $475 and Caleb $225....All respectfully submitted and reported to your Worships this 29th Dec'r 1846. B. B.
