This indenture made the eleventh day of November one thousand seven hundred and seventy-seven between John Christmas of the County of Bute and the state of North Carolina of the one part and Hugh Hayes of the county and state aforesaid Witnessed the said John Christmas for and in consideration of the sum of eight hundred pounds Virginia money to him in hand paid by the said Hugh Hayes hath granted bargained sold aliened conveyed and confirmed and by these presents do the grant bargain sell alien convey and confirm unto the said Hayes his heirs and assigns forever a certain tract or parcel of land situate lying and being in the aforesaid county containing by estimation four hundred and forty-eight acres more or less. Beginning at a corner hickory in Colonel Hawkins' line running a south course to the south corner thence east down Childress' line to the road thence along the road to a corner red oak sapling then north along a chopped line in the head of the spring branch thence down the said branch near to the creek thence along a chopped line to the beginning. To have and to hold the tract of land and premises with their and every of their appurtenances thereunto belonging unto the said Hugh Hayes his heirs and assigns to the only proper use and behoove of him the said Hugh Hayes his heirs and assigns forever and the said John Christmas for himself and his heirs and the said tract or parcel of land and all and singular other the premises with their appurtenances unto the said Hugh Hayes his heirs and assigns forever against him the said John Christmas and all and every other person whatsoever. In witness whereof the said John Christmas hath hereunto set and affixed his hand and seal the day and date above written. John Christmas {seal} Signed sealed and delivered in presence of James Milles Bute County February County 1778 John Christmas acknowledged this deed to Hugh Hayes and the wife of the said John being privately examined by William Person, Esquire appointed by the court for that purpose and thereto consisting relinquished her right in the land conveyed by her husband and the same was ordered to be registered.
