State of No Carolina Warren County
 
In the name of God amen.
 
I Whitmel Alston, of the County and State aforesaid being of sound and perfect mind and memory, do this the twenty second day of February one thousand eight hundred and twenty four make and ordain this my last will and Testament, revoking all others.
 
1. Item, I give and bequeath to Whitmel H. Alston Kearney the following Negroes, by name (viz) Frank,Peter, Mason, Cloey, Harriet and William. Also I give and bequeath to Whitmel H. Alston Kearney, all the Land that I own with all my household and kitchen Furniture and four wheel carriage, the Land I wish his farther to dispose of should he think it advisable, and the proceeds to go to said Whitmel H. Alston Kearney, and should he die before he marries or comes of age, I wish all the above named property to go to his mother, B. H. J. M. A. Kearney.
 
2. Item, give to my Brother Samuel Alston two Negroes (viz) by name Jacob and Anderson.
 
3. Item, I give and bequeath to Polly H. Alston Daughter of my Brother Philip two hundred dollars.
 
4. Item, I give and bequeath to my Brother Thomas Alston my bay horse and gun.
 
5. Item, I give and bequeath to Carolina Cornelia Kearney my gold watch.
 
6. Item, after paying all my just debts, the balance of my property of every description not given a way I wish to be divided in four equal parts and that the Heirs of my Brother Philip Alston to be entitled to one fourth, my Brother Samuel Alston one forth, my Sister Martha Hawkins one fourth, and my Sister B. H. J. M. A. Kearney one fourth part. In witness whereof I have hereunto set my hand and affixed my seal this 22 Feb one thousand eight hundred and twenty four.

This last will and Testament of Whitmel Alston was exhibited in open court for probate and the execution thereof being proved by the oaths of Miles Bobbitt and Susanna Bobbitt subscribing witness thereto, on motion it is Ordered to be recorded. whereupon Wm. K. Kearney qualified as Administrator with the will annexed.
