Will of

Samuel Charles 

12 March 1727/28,

Perquimans County

In the name of god amen the twelth day of March 1727/28 I Samuel Charles of poquimons being very sick and weak in body but of perfect mind and memory thanks be given to  god therefore calling unto mind the mortality of my body and knowing that it is appointed for all men once to dye to make and ordain this my last will and Testament  that is to say principally and first of all I give and recommend my soul into the Hands of god that gave it and my body I recommend to the Earth to be buried in in Decent Christian burial at the discretion of my Executor nothing doubting but at the General Resurrection that I shall receive  the same again by the mighty power of god and as touching such worldly estate where with it hath pleased god to bless me. I give demise and dispose of the same in the following manner and form. Item  I give to my wife half my plantation where I now live during her widowhood if she sould marry she is to have but her thirds.

IMPRIMIS I give and bequeath to my son Samuel Charles the plantation and land whereon I now live to him and his heirs lawfully begotten of his body for ever. If he should dye without such heirs then to falls to his brother John Charles and his heirs lawfully begotten of his body  for ever.

Item I give to my son John Charles a tract of land out back betwix the head of the lower gum swamp and the head of the bull branch to him and his heirs forever.

Item  I give to my son Josuay Charles a small tract of land on the north east side of the lower swamp to him and his heirs for ever.

Item I give to Sarah Maudlin one young cow.

Item I give to my Grand Daughter Eliz” Overman one two year old heifer.

Item I give to my Daughter Lidey Charles one young cow and calf.

Item I give all the rest of my cattle be equally divided betwix my wife and my Daughter Sarah Charles and my son Josuay Charles and my Daughter Hannah Charles.

Item I give to my daughter Mary Overman two ews and lambs .

Item I give all the rest of my sheep to be equally divided betwix my wife and other children.

Item I give my wife the use of the feather bed and furniture that I now lie in for her natural life and after her death to my Daughter Hannah.

Item I give all my hogs to my wife for to pay what debts I owe and to bring up my small children.

Item I give to my two sons Samuel and John my two guns each of them one.

Item I give the labor of my Negro woman to my wife during her widowhood for the maintainment of my small children after her deceas or marriage then the Negro woman to work one year with my son Josuay Charles and one year with my Daughter Hannah during the Negroes life.

Item I give to my son John Charles one feather bed with an osenbrigs tick 

Item I give to my wife my white horse called Smoker 

Item I give to my son Samuel my greate table and form

Item I give all the rest of my household goods that is not already given to equally divided betwix my wife and children.

Item I give to my son Josuay Charles one young two year old horse.

Item I give to my Daughter Lidey one yearling mare.

Item I give to my daughter Mary Overman one bay mare 

Item I give one gray mare and her increase betwix my two daughters Sarah Charles and Hannah Charles

Item I leave my great horse called Caper for the use of the plantation and if he proves unluckey then my Executors has power to swap or sell him for money to buy another

Item I likewise constitute make  and ordain my two sons Samuel Charles and John Charles of this my Last Will and  Testament and I do hereby utterly disannul all other wills that have here to fore been by me made. In witness my hand this day and the year above written–

THE SANDERS FAMILY by Gwen Boyer Bjorkman, 4425-132nd Ave. S.E., Bellevue, WA 98006, in correction of an article written by me and published in THE QUAKER YEOMEN Vol. 10, No. 3, Oct. 1983.

“Whereas John SANDERS of Nanzemond County in Virginia and Prissilla PRITLOE Dafter of John PRITLOE of ye County of Albemarl in Pequimans River in North Carolina haveing declared their Intentions of takeing each other in mariage before severall Publick meetings of the people Called quakers in Caralina” were married on the 8th day of the 1st month called March 1715/6.

Included in the witnesses to the marriage were Abraham SANDERS, son of John, and the parents of Priscilla, Elizabeth and John PRITLOE, along with their daughters Leah, Rebecca, Elizabeth, Judith, and Rachel with her husband Robert Wilson. In five months Abraham SANDERS, “Late of Virginia” was to marry Judith PRITLOE at a meeting at John PRITLOE’s house where three of his daughters were married and “Timothy CLARE and Samuel NICHOLSON were appointed to stay at John PRITLOE’s the night after the wedding to see that there be no disorders.” It must have seemed like an occasion for a celebration for the PRITLOES.

John SANDERS did not attend the wedding of his son, Abraham. I believe that he had returned to Nansemond County with his bride. There are no deeds or tax records for John SANDERS in Perquimans as there are for Abraham SANDERS. Since all of the Nansemond County records have been destroyed, there is only the 1704 tax list which lists two John SANDERS. There are some land grants in Nansemond, but it cannot be determined for sure if they are for this John SANDERS.

John and Priscilla SANDERS had two daughters born to them before Priscilla’s early death. Then John SANDERS died in 1728. The estate was complicated by the death of John PRITLOE and his wife Elizabeth and their estates were probated in 1728. Elizabeth had left a negro slave to her granddaughters, Judith and Priscilla SANDERS. Zachariah CHANCEY, who had married Rebecca PRITLOE, immediately filed for guardianship. The subsequent struggle over the estate gives us the genealogical proof that we need for this line from the Perquimans records.

The Friends took up the cause of their staunch member, Abraham SANDERS. “1728, 12,5 It was agreed on by this mtg that Abraham SAUNDERS have his sister, Judeth to take care of & bring up according to his father’s desire.” “1728/9,1,5 Whereas Zachariah CHANCEY & His wife refuse to comply with ye order of last mo mtg concerning letting Abraham SAUNDERS having his sister, Judeth ye mtg appts W. MOOR, Sr., Thos. JESSOP, Nathan NEWBY & Francis NEWBY to go & discourse with them whether they think themselves to be of us or to be not in unity with us.”

Meanwhile, another son of John SANDERS, Richard SANDERS had married and applied for guardianship of the two girls. “July Court 1735. CHANCEY petition vs SANDERS: The Petition of Zach. CHANCEY praying the Estate of Judeth and Percila SANDERS out of the hand of Richard SANDERS dismist the said Richard SANDERS giving Bond and Security for the said Estate which said Bond is filed in this office.”

By this time the girls had grown up and after the marriage of John PENDLETON with Judith SANDERS, he sued for her estate from Richard SANDERS. In 1737 Priscilla SANDERS asked to name her own guardian, Thomas PIERCE, and to get her estate from her uncle Zachariah CHANCEY.

The family is further verified when Abraham SANDERS names his brother Richard SANDERS as Executor of his will in 1750 and when Richard SANDERS names his cousin John SANDERS, son of Abraham as Executor of his will in 1769. With the above records, we can construct the following family.

1. John1 SANDERS was born before 1676 and died probably in Nansemond Co., Virginia circa 1728. His first wife is unknown. He married (2) at Perquimans Co., N.C., 8, 1m, 1715/16, Priscilla PRITLOE, daughter of John and Elizabeth PRITLOE.

2. i. Abraham SANDERS, m. 16, 6m, 1716, Judith PRITLOE, dau of John and Elizabeth PRITLOE, the sister of his father’s 2nd wife. She was b. 2 Dec. 1696, Perquimans Co., N.C., d. aft. 1751. He d. bef. Oct. 1751 when his will was probated in Perquimans Co., N.C.

+ 3 ii. Richard2 SANDERS , m. Hannah NICHOLSON, dau of John NICHOLSON and Priscilla TOMS, 14, 8m, 1730, Perquimans Co., N.C. He d. bef. April 1770 when his will was probated in Perquimans Co., N.C.

3. Richard2 SANDERS married at Perquimans MM 14, 8m. 1730, Hannah NICHOLSON, daughter of John NICHOLSON and Priscilla TOMS who had married 20 Nov. 1700. John NICHOLSON died before the 2nd marriage of Priscilla to John KINSEY 23, 6m, 1711 at Perquimans MM. On the 12 August 1712, John NICHOLSON’s will was proved naming his wife “Pressela” and children, Samuel, Mary and Hannah. Priscilla and John KINSEY had one daughter, Elizabeth, born before he died and the 3rd marriage of Priscilla to John SYMONS 8, 1m, 1721/22 at Perquimans MM. John KINSEY’s will was proved 14 April 1719 naming his daughter, Elizabeth, and his daughters-in-law Mary NICHOLSON and Hannah NICHOLSON and his son-in-law Samuel NICHOLSON. [The term daughter-in-law was at that time used for stepdaughter.]

The proof of the NICHOLSON line is further verified by the Deed Records. By his will probated in 1698, Joseph NICHOLSON had left a 100a plantation on the Perquimans River to the male heirs of his brothers John, Nathaniel and Benjamin and all of them failing to have male heirs to the heirs of his five brothers, Samuel, John, Nathaniel, Benjamin and Christopher. Therefore in 1743 this piece of land, called “Log House Land” was sold for £236 “and for divers other good causes & considerations” by the heirs of Samuel, Nathaniel and Christopher [Benjamin dying without heirs] to Richard SANDERS who had married the only surviving heir of John NICHOLSON, Hannah (NICHOLSON) SANDERS who had a one fifth right to the land.

Then in the will of Richard SANDERS dated 4 Dec. l769: “I give to my son John SANDERS Twenty Acres of Land which was his Mothers Right to him and his Heirs for ever. I give to my Daughter Elizabeth SANDERS all the Remainder of my Land and Plantation whereon I now Live being Eighty Acres” I believe that this amply proves that Hannah was the daughter of John NICHOLSON and Priscilla TOMS.

6. John3 SANDERS was born 28 July 1731 in Perquimans Co., N.C. and died there before his fortieth birthday when his wife Miriam SANDERS, her brother John SYMONS, and Benjamin ALBERTSON made bond at the Perquimans County Court to administer his estate on the 12th of October 1770. He left a large family and a small estate. John SANDERS had married Miriam SYMONS at Pasquotank Monthly Meeting and the births of their first five children are recorded there. Miriam SYMONS was born 17, 6m, 1728, the daughter of Thomas SYMONS and Ann (KEATON) BUNDY SYMONS.

Miriam SANDERS died and left a will that was probated at Perquimans County Court in 1781 naming her seven living children. Her son Thomas SANDERS died in 1789 leaving a will naming his sisters and brothers and the family can be constructed from these two wills and the Pasquotank Monthly Meeting records.

11. Anne4 SANDERS was born 8, 1m, 1761 in Pasquotank Co., N. C. and died probably before 1798 in Perquimans Co., N. C. A marriage bond in Perquimans Co., N.C. was made for Ann SANDERS and Joseph PERISHO 15 Oct. 1785 and Benjaman SANDERS was bondsman. Ann PERISHO, formerly SANDERS was dismissed for marriage contrary to discipline by the Perquimans MM 5, 12m, 1785. Joseph PERRISHO was dismissed for marrying a near relative to his former wife contrary to discipline 4, 1m, 1786. Anne SANDERS was the niece of Joseph PERISHO’s former wife, Elizabeth (SANDERS) PERISHO who had died before January Court 1785 when her will was probated.

Elizabeth (SANDERS )PERISHO had inherited the NICHOLSON “Log House Land” of 80a from her father, Richard SANDERS. Immediately after the settlement of her father’s will in 1770, her brother, John SANDERS, had sold to her the 20a that he had inherited as his Mother’s right to him. Elizabeth owned the full 100a when she married Joseph PERISHO in 1772. Then in her will in 1783 she left this land where she lived in the “Old Neck” to her husband during his natural life and after his death it was to go to her cousin [nephew] Richard SANDERS as long as he would make over to his two youngest brothers Joseph and Benjamin SANDERS the land where he then lived at the head of Suttons’s Creek. Elizabeth (SANDERS) PERISHO did not have children.

Anne (SANDERS) PERISHO probably died before 9, 12m, 1797 when Joseph PERISHO condemned his marriage contrary to discipline and was reinstated at Suttons Creek MM. Joseph PERISHO, son of John PERISHO deceased, of Perquimans Co. than married Elizabeth ALBERTSON, daughter of Elihu ALBERTSON deceased, of Perquimans Co., 14, 1m, 1798 at Suttons Creek MM. Joseph PERISHO died in 1802 leaving a will naming his two sons, Joseph and John PERISHO. Elizabeth settled his estate as both Elizabeth PERISHO and Elizabeth PARKER for on the 11, 4m, 1807 Elizabeth PERISHO was reported married to Enoch PARKER at Suttons Creek MM.

This company, known as the “Perquimans  Beauregards” was raised in Perquimans County and enlisted at Hertford in Perquimans County. The company was composed initially of both infantry and cavalry contingents but was soon converted to a standard infantry organization. The company was mustered in on May 16, 1861; it remained in camp in Perquimans County until ordered to New Bern on July 3. On July 19 the company departed on board the steamer Curlew and traveled to New bern via the Perquimans River, Albemarle and Pamlico Sounds, and the Neuse River. Upon its arrival the company was assigned to a battalion which later became the 27th Regiment, N. C. Troops (Infantry) and the Perquimans Beauregards became Company F of that unit. After joining the regiment, the company functioned as a part of the regiment, and its history for the war period is reported as a part of the regimental history.

CAPTAINS 

NIXON, WILLIAM – Enlisted in Perquimans County. Elected Captain on or about May 16, 1861. Present or accounted for until he was defeated for reelectionwhen the regiment was reorganized in April, 1862

JONES, THOMAS D. – Was by occupation a clerk prior to enlisting in Perquimans County. Elected 3rd Lieutenant on May 16, 1861, and was elected 2nd Lieutenant on August 20, 1861. Elected Captain on April 22, 1862. Wounded in the abdomen and kidney at Bristoe Station, Virginia, October 14, 1863. Hospitalized at Richmond, Virginia where he died on November 7, 1863 of wounds.

SKINNER, BENJAMIN S. – Resided in Perquimans County where he enlisted on May 16, 1861. Mustered in as Sergeant and was elected 2nd Lieutenant on April 22, 1862. Wounded at Sharpsburg, Maryland, September 17, 1862. Returned to duty on an unspecified date. Promotes to 1st Lieutenant on November 15, 1862, and was promoted to Captain on November 8, 1863. Killed at Reams’ Station, Virginia, August 25, 1864

LIEUTENANTS

MARTIN, THOMAS DUNCAN, 1st Lieutenant – Born in Pasquotank County where he resided as a doctor prior to enlisting in Perquimans County at age 46. Elected 1st Lieutenant on or about May 16, 1861. Detailed in hospital in New Bern on or about July 1, 1862. Reported absent on detail at New Bern until transferred to a hospital at Greensboro on or about February 15, 1862. defeated for reelection on or about April 22, 1862.

MEBANE, WILLIAM A.,  2nd Lieutenant – Resided in Perquimans County where he enlisted on May 16, 1861. Mustered in as Private and was elected 3rd Lieutenant on April 22, 1862. Wounded at Sharpsburg, Maryland, September 17, 1862. Returned to duto on an unspecified date. Captures at Bristoe Station, Virginia, October 14, 1863. Confined at Old Capital Prison, Washington, D.C. Promoted to 2nd Lieutenant on October 16, 1863, while a prisoner of war. Transferred from Old Capital Prison to Johnson’s Island, Ohio, November 11, 1863. Released on June 12, 1865, after taking the Oath of Allegiance. Records   of the Federal Provost Marshall dated 1865 gave his age as 32.

NIXON, FRANCIS, 3rd Lieutenant – Resided in Perquimans County where he enlisted on May 16, 1861. Mustered in as Sergeant. Captured at New Bern on March 14, 1862. Confined at Fort Columbus, New York Harbor. Exchanged on an unspecified date. Promoted to Quartermaster Sergeant on May 1, 1862, and was elected 3rd Lieutenant on November 28, 1862. Wounded in the right leg at Bristoe Station, Virginia, October 14, 1863. reported absent wounded until October 5, 1864, when he was retired to the Invalid Corps.

RIDDICK, ELBERT T., 1st Lieutenant – Enlisted in Perquimans County on May 16, 1861. Mustered in as 1st Sergeant and was elected 3rd Lieutenant on November 15, 1861. Elected 1st Lieutenant on April 22, 1862. Present or accounted for until wounded at Sharpsburg, Maryland, September 17, 1862. Died on November 16, 1862, of wounds. Place of death not reported.

WHITE, JOSHUA W., 2nd Lieutenant – Enlisted in Perquimans County. Appointed 2nd Lieutenant to rank from May 16, 1861. Appointed Assistant Quartermaster on or about September 5, 1861, and transferred to the Field and Staff of this regiment.

WILSON, WILLIAM A., 3rd Lieutenant – Enlisted in Perquimans County on May 16, 1861. Mustered in asa Corporal and was promoted to Sergeant on November 15, 1861. Elected 3rd Lieutenant on September 1, 1864. Present or accounted for through December 1864. [Paroled at Greensboro, May 1, 1865]

ALBERTSON, JOSEPH, Private – Enlisted in Perquimans County on May 16, 1861. Present or accounted for through July 26, 1864; however, he was reported on duty as a teamster during most of that period.

ALBERTSON, THOMAS, Private – Born in Perquimans County where he enlisted on May 16, 1861. Present or accounted  for until he died “at home” on June1, 1862. Couse of death not reported.

ALDRIDGE, WILLIAM, Private – Resided in Union County and enlisted in Wake County or at Petersburg, Virginia, November 1, 1864, for the war. Present or accounted for through January 5, 1865. Captured by the enemy on an unspecified date. Confined at Point Lookout, Maryland, until released on or about June 22, 1865 after taking the Oath of Allegiance.

ARRINGTON, HENDERSON, Private – Enlisted in Perquimans County on September 1, 1861. Present or accounted for through December, 1864.

BANKS, WILLIAM H., Private – Enlisted in Perquimans County on May 16, 1861. Present or accounted for until July-August, 1862, when he deserted.

Confined at Fort Delaware, Delaware. Transferred to Aiken’s landing, James River, Virginia, October 2, 1862, for exchange. Declared exchanged at Aiken’s Landing on November 10, 1862.. Returned to duty on an unspecified date. Wounded in the right wrist at Bristoe Station, Virginia, October 14, 1863. Returned to duty prior to January 1, 1864. BARKER, DANIEL, Private – Born in Randolph County and was by occupation a farmer prior to enlisting in Wake County on December 7, 1863 for the war. Hospitalized at Frederick, Maryland where he died on November 12, 1862 of “pneumonia.” Death records give his age as 16.

Reduced to ranks prior to January 1, 1862 but was promoted to Corporal in March-April, 1862. Present or accounted for until captured at Winton on May 31, 1863. Confined at Fort Monroe, Virginia. Paroled and transferred to City Point, Virginia, July 16, 1863 for exchange. Was reportedly transferred to Company D, 66th Regiment N. C. Troops in November-December, 1863; however, records of that unit do not indicate that he served therein. No further records.

Present or accounted for until wounded in the left side at Sharpsburg, Maryland, September 17, 1862.Present or accounted for until captured at Bristoe Station, Virginia, October 14, 1863. Confined at Old Capitol Prison, Washington, D.C. until transferred to Point Lookout, Maryland on October 27, 1863. Paroled at Lookout Point and transferred for exchange on or about October 30, 1864. Company records do not indicate whether he returned to duty; however, North Carolina pension records indicate that he survived the war.

WHITE, WILLIAM FRANK, Private – Enlisted in Perquimans County at age 21, May 16, 1861. Never mustered into service and was dropped from the rolls of the company on or about January 1, 1862. [North Carolina pension records indicate he was wounded in the arm at Camden Court House, North Carolina in 1863.

WILLIAMS, WILLIAM T., Private – Born in Perquimans County and was by occupation a farmer prior to enlisting in Perquimans County on May 16, 1861. Present or accounted for until discharged on July 16, 1862 by reason of being over age. Discharge certificate gives his age as 35.

WINSLOW, WILLIAM A., Private – Born in Perquimans County where he enlisted on June 1, 1861. Present or accounted for until he died in a hospital at Kinston on May 28, 1862. Cause of death not reported.

WOOD, GEORGE H., Private – Born in Perquimans County and was by occupation a farmer prior to enlisting in Perquimans County on September 1, 1861. Present or accounted for until discharged on July 16, 1862 by reason of the expiration of his term of service. Discharge certificate gives his age as 17.

WOOD, JOSEPH R., Private – Born in Perquimans County and was by occupation a farmer prior to enlisting in Perquimans County on May 16, 1861. Present or accounted for until discharged on July 16, 1862. Reason discharged not reported. Discharge certificate gives his age as 28.

WOOLEY, JOEL, Private – Enlisted in Wake County  on May 30, 1864 for the war. Present or accounted for until wounded at Reams’ Station, Virginia on August 25, 1864. Returned to duty in November-December, 1864. Present or accounted for through December, 1864.

Thomas White was a subject in the colony at Jamestown, 1609. (Browns Genesis to America.)

James White in Va same date, at same place. Henry White of York Co Va, had a son Henry, who moved to Isle of Wight. From the dates it seems probable that this was the identical Henry White who migrated to Perq Precinct N. C., before 1670. He built the first Quaker Church in Perquimans, thought to be Little River Mo meeting, which was about where Woodville is situated. Just beyond the confines of this village can be seen at the present time an old Quaker burying ground, with small stones such as were in common use at that day among the simple Quakers. Meetings were held at the house of Henry White, 26, 4mo 1690, at which time, James Davis (s of William) and Elizabeth White (d of Henry) of Albemarle, took each other as man and wife. Another Quarterly meeting convened at the house of Henry White, 1, 3mo 1695, when it was “agreed that Robert Wilson, Francis Toms, & Henry White, doe write a letter in behalf of the Meeting, to friends at yearly meeting in London.” At a meeting held at the house of Arnold White, 24, 4mo 1679, there were present: Henry White, Timothy Meade, Francis Toms, Charles Moris, Jonathan Tailer, Arnold White, George Tailer, Mary White, Rebecka Simons, Solomon Pool, & Margaret White. The children of Solomon Pool were registered at this meeting, as follows: Richard, b 2, 3mo 1680—Ane, b 12, 2mo 1682—Mary, b 15, 10mo 1683—Solomon (2) b 23, 4mo 1687.

As Arnold appears in Perq simultaneously with Henry White, the inference may be drawn with some certainty, that they were brothers, but the records do not mention the fact. John and William White also made their entry into Perquimans about the same time, and they may also be brothers.

The will of Henry White, p in Albemarle, Sept 19, 1706, names the following issue: Henry, Arnold, Isaac, Robert, & John, to whom he devised his “Maner plantation,” dau’s: Content and Naomy. (No wife is mentioned.) Henry White bought land in Surry Co Va, June 9, 1655 (Surry records). He made an affidavit in Perq Co, 1689, giving his age as 57 years. (Gen’l Court, May 26, 1689.)

The legatees in said will being wife Margaret, William & Elizabeth Tetterton (Step-children).

She had by first husband Francis & Elizabeth Foster, named in his will—Oct 9, 1687. Diana White m 3 times, 1st Thomas Harris, Clerk of Perq, 2d William Foster, & 3rd Thomas White. Perq Court was held in the house of Thomas Harris, and after his death, 1679, at the house of Diana Harris, Sept 1679, and still later, at the house of Thomas White, presumably the same house each time. Thomas White in his will Mar 11, 1695, names wife Diana, and William Collins, who it is thought m Elizabeth Harris, d of Diana by her 1st husband.

Thomas White Line

  • In Perquimans Co. there seems to have been two separate, & distinct, lines of this family, that of Henry White, and the descendants of Thomas, of Isle of Wight Co Va. Henry White pioneered to N. C. much earlier than the last named. It is thought, but not proven, that Thomas of Isle of Wight, was a descendant of John White, who came to Va, from New England, & took up land in Norfolk Co.

From this line sprang Dr White of Suffolk Va, who is a son of Joshua W. White, named in the last will. (See Jordan family, for Rachel Whites Will.)

White, Mourning, spoken of in the Henry White line, as wife of John White, & mother Robert, (who m Rebeccah Albertson,) may have been a d of Joshua (1) & wife Gulielma. The Whites, & Winslows, crossed so many times, it is difficult to distinguish, one from another. Robert (s of John) died 25, 6mo 1830. This seems all the more to be credited, from the fact that Robert, & Rebeccah had a son named Jordan White, b 8, 9mo 1821, died 21, 6mo 1822.

White, Joseph, (s of Joshua, & Rachel (Jordan) White) is mentioned in his will, but his age is not given. From the fact that five years intervened, between the date of Elizabeth, & Joshua Jordans ages, it is probable that he is the one between. Benjamin White also has no birth date, but we know from his fathers will, that he was the youngest child.

William Bundy, had previously married Elizabeth —, probably before coming to N. C., who died Mar 4, 1676, by whom he had one son Samuel, b Feby 4, 1676. Also a dau Mary, who was 1st wife of Timothy Clare. In her marriage bond, she is named as his dau. He had by his 2d wife Mary (née Scott) widow Pearre) a dau, Sarah b Jan 23, 1685, who married Francis Pettitt, of Chowan Co.

David Bundy of Perq, will p April 1750, names brothers: Jeremiah, Moses, & Caleb. Uncle Josiah Bundy. (He evidently died without issue.)

Caleb Bundy, of Pasq Co, will April 27, 1721, Sons: John, Benjamin, Samuel, (to whom he left all his land, “up Little River”) d Mary Bundy (land bought of brother Samuel) gr-dau Liday Bundy, (d of son William). His wife is not named.

Anne Bundy, will Pasq Co, p Dec 1744. Sons: Gideon, (his wife Miriam née Bogue) Abraham, gr-dau Lydia Bundy. (She was widow of Samuel Bundy.)

Benjamin Bundy, of Pasq Co, names in his will, Pasq Co, p Oct 26, 1728, Wife Hannah, to whom he left a plan’ of 1,200a. Brother Samuel Ex.

William Bundy of Perq, will p Jan 1749, names dau Sarah Barrow (wife of Joseph) wife Mary.

The Bundys lived on the edge of Pasquotank Co, & some of them in Perq. They were identified as much with one County, as another.

The will of Josiah Bundy, is found in Minute book, 1755-61, (Perq Co Records). Said will dated 28, 12mo 1760. Made bequest to son Joseph, 39a of Wood land, adj where he now lives, To s Gideon all land in Pasq Co, To wife Elizabeth, all land in Perq, “for her Natual life, but not so as to hinder, my sons Ellis, & Joshua, from settling on their part of sd land” also 76a in Pasq Co, on the head of Little River, called “the forks.” To s Joshua the other half of land, adj Francis Nixon, & half on a new Survey in Perq. To sons: Ellis, & Joshua, “all Right in 300a in Pasq Co, & all three patents in Perq, taken up by myself, Thomas Nicholson, & Gideon Bundy.” To s Caleb 76a in Pasq Co, “which I had of Gideon, & Lydia Bundy.” To d Jane a negro girl. Sarah Bond Executrix of Richard Bond deced & John Perry complaine against John Keatton of North Carolina aforesayd planters alias Dick: John Keatton of the upper parish of Nansemond County in Virginia in custody of the Marshall &c. of a place that he render to them the full & just Sum of thirty pounds current & lawfull money of Virginia which to them he oweth & unjustly detaines &c for that to witt that whereas the sayd Deft. in the province of North Carolina aforesd on the twenty fifth day of October Anno Dm One thousand seven hundred twenty seven by his certain Bond Signed with the sayd Defts marke sealed with his Seale dated the same day and year & here in Court produced did firmly bind himself to payment the sayd Richard Bond & John Perry the aforesayd sum of thirty pounds current & lawfull money of Virginia when he should be thereto
required yet Nevertheless the sayd Deft the aforesayd Sum of thirty pounds current & lawfull money of Virginia to the sayd Richard Bond in his lifetime next to his Exetrx since his death & John Perry hath not payd nor to either of them tho he hath been often thereto required but the same to do hath altogether denyed & refuted which is to their damage twenty pounds & therefore
they bring this Suite, &c.

Whereas in the Suite brought by Sarah Bond Executrix of Richard Bond deced against Edward Moudlin, Richard Whedbee & Joshua Toms at October Genl. Court last the Said Edward Moudlin tho Solomnly required came not and the Marshall having returned the Writt Executed on his Body but fild no baile bond therefore at the Plats. Mocon an order was past against the Marshall for two hundred & twenty pounds Damages with Costs and at the Sayd Marshall’s request an Attachment was then and there granted against the Estate of the Said Edward for the like damages with all accruing Costs returnable to the next Court the last Tuesday in March next.

Wee therefore autherise and impower you to attach the Goods & Chattells of ye said Edward Moudlin if to be found in your Bailiwick, to ye Value of ye damages aforesd. with Costs repleyable on Security given & Safely keep ye same so as to compell him to appear at ye next Genl. Court to be held for this Governmt. at Edenton on ye last Tuesday in March next to make answer to the Plea of the Plt: aforesd. herein faile not & make due return.

Know all men by these presents that I, John Keatton of the upper parrish of Nansd. County in Virginia am held and firmly bound unto Richard Bond and John Perry of the place aforesd. in the full and just sum of thirty pounds current and lawfull money of Virginia to the which payment well and truly to be made I bind my self my heirs executors and administrators firmly by these presents as witness my hand and seale this 25th day of October Anno Dom. 1727.

The Condition of the above obligation is such that if the above bound John Keatton his heirs Exers. or admrs. shall and do make and deliver or cause to be made and delivered to the above written Bond and Perry a good and sufficient title sufficient to warrant the said Richard Bond and John Perry in quiet and peaceable possession of one hundred and fifty eight acres of land lying and being in Pequimons precinct on the northeast side of Pequimons River joyning on the line of Nathanell Sutton it to be complyed with att the request of the said Richard Bond and John Perry then the above obligation to be void and of no effect, otherwise to stand and abide in full force and virtue.
