THE LAST WILL AND TESTAMENT

OF

AMBROSE BURFOOT

December 31, 1823

In the name of God Amen, I AMBROSE BURFOOT of the County of Camden & State of N. Carolina, being weak of body but of perfect sound mind and memory thanks be given unto God, and calling unto mind the mortality of my body, and knowing that it is appointed for all men once to die. I do make and ordain this to be my Last Will and Testament, disannulling all other wills heretofore by me made—which I give and dispose in manner and form as follows.

Item. I give and bequeath unto my dearly Beloved Daughter POLLY SAWYER that tract of land that I bought JOSEPH NEEDHAM containing about thirty seven acres to her & her heirs lawfully begotten of her body forever.

Item. I give and bequeath unto my dearly beloved Daughter LYDIA WILLIAMS that tract of land that I bought of JOHN G. WRIGHT containing about fifty acres to her & her heirs lawfully begotten of her body forever.

Item. I lend the use of the land and plantation whereon I now live also a small tract of land that I bought of PRUDENCE OGGS unto my dearly beloved Wife ALAF BURFOOT, also two cows & calves her choice, one mare by the name of Gin, two feather beds & furniture her choice, two linen wheels, one beaufat & crockery in it, once chest, and all the kitchen furniture until death or marriage and at death or marriage as hereafter named, its further my will that my Wife ALAF BURFOOT should have one sow & piggs, five barrows, choice, also four head of sheep choice.

Item. I give & bequeath unto my dearly beloved Son ROBERT BURFOOT, the Mill Dam tract of land containing about fifty acres, one saddle, & sixty dollars in good notes for the purpose of purchasing a horse to him & his heirs lawfully begotten of his body forever.

Item. I give & bequeath unto my dearly beloved Son JABEZ BURFOOT all the land that I now hold on the Great Island to him & his heirs lawfully begotten of his body forever.

Item. I give & bequeath unto my dearly beloved Son JOHN BURFOOT that tract of land in Sandy Hook containing sixty acres to him & his heirs lawfully begotten of his body forever.

Item. Its further my will that my two dearly beloved Sons WILLIS BURFOOT & WILLIAM BURFOOT at my Wife’s death or marriage should have the plantation I now live on also a small tract I bought of PRUDENCE OGGS equally divided between them to them and their heirs lawfully begotten of their body forever.

Item. Its further my will that the house and lot down the river should sold on a credit of twelve months also negro Jupiter & negro Robert should be sold on the above named credit, and the residue of my estate consisting of stock and house hould furniture etc. should be sold in a credit of six months.

Item. Its further my will that after paying all my just debts and lawful expences that theres due of my estate should be equally divided between my five Sons, ROBERT BURFOOTJABEZ BURFOOT, JOHN BURFOOTWILLIS BURFOOT,WILLIAM BURFOOT, to them & their heirs lawfully begotten of their bodies forever.

Lastly of all I appoint & dinominate my faithful and trusty friends SILAS FORBES and ROBERT BURFOOT to be my whole & sole Executors this 31st. day of December 1823.

TOXEY, MILTON NEEDHAM – (d. 1968)

Milton Needham Toxey, 84, of 104 w. Main St. died Monday at 4:30 a,m. in Albemarle Hospital after a short illness. He was a native of Shiloh and lived in Elizabeth City for the past  35 years.  He was the son of the late Wiley and Bettie Needham Toxey.  A member of the First Baptist Church, he led the singing  in the Mens Bible Class for 35 years. He was also a former school teacher and retired farmer.  He was the oldest  funeral director in this area. He started in the business in Camden County in 1932, moved to Elizabeth City and operated the Pierce and Toxey Funeral Home until 1939. He moved to main street  and operated until his retirement in 1964. He also operated the Shiloh Gining Co.  He is survived by His wife, Mrs. Mary Forbes Toxey, two daughters, Mrs. John A. Dwiggins of Greensboro and Mrs. Thomas J. Duren of Norfolk, One son Milton Wiley Toxey  of Shiloh  and six grandchildren. A funeral  service will be conducted Tuesday at  4:00 p. m. , in Twiford Memorial Chapel  by the Rev. Maynard Magnum, pastor  of the First Baptist Church, and the Rev. C. Aubrey McLellan, pastor of Shiloh Baptist Church. Burial will follow in Hollywood Cemetery. –March ,25. 1968

LEARY, NANCY J. (d. 1939)

Mrs. Nancy J. Leary  —– Old Trap.- Mrs. Nancy Jane Leary, 68, died suddenly at her home here at 10:45 Monday night of a heart attack shortly after returning from a club meeting.

She is survived by two sons, Wilson Leary and A. N. Staples of Old Trap; two daughters, Mrs. S. F. Forbes of Riddle and Mrs. S. N. Richardson of Norfolk; two sisters, Mrs. John Garrington of Popular Branch and Mrs. K. S. Sawyer of Beaufort; two brothers, C. C. Needham of Whiteville and G. M. Needham of South Mills.

BURGESS Family Bible (ROBERT T. & MARGARET ANN KIGHT BURGESS)

This Bible record has not been seen for, as I understand it, about 30 years or more. It belongs to the Ella Hubbard Burgess Riggs (born 1902 and still living in Camden), listed in this Bible record. It has been transcribed by me as written.

This particular text has been cited numerous times in the past, most often in reference to the wife of Zachariah Kite (Kight) and the date of birth of Zephaniah Kite (Kight). She, Claypia (Clarpalia), wife of Zachariah Kite (Kight), has been frequently cited as having been an Indian. This Bible alone has always listed as the reference for this statement. As you see, there is no information regarding her, other than her relationship as the wife of Zachariah Kite (Kight). As far as I know, the only other reference to her is in a deed. With that, there is no evidence to support the long-standing tradition that she was an Indian. I must state, however, that her name, regardless of spelling, is nothing like any other name I have seen in the region. Some of the Kight family did live close to the Indiantown area on the border of Camden and Currituck Counties. The Indians that resided in the area were not for the most part, as many people have assumed, members of the Pasquotank tribe. The Pasquotanks had long since dispersed from the area or had been absorbed into the settling population, both white and slave. The vast majority of the Indians in Camden County, if not all of them, by the mid-1700s were of the Yeopim tribe that was placed on a 10,000 acre reservation in the Indiantown area in about 1704 as noted in a deed from Lord Granville to the Yeopim Indians. The Yeopims had previously lived in the southern part of Perquimans County and parts of Chowan County. If Clarpalia was an Indian, she was more than likely a member of this tribe.

I can not comment definitively on her origins. I can, however, state that, given her name, location, and dates, there is a good possibility that she was indeed an Indian as according to family tradition. Still, I think that every Camden County, NC Kight family researcher should examine the scant references to her, take into account the history of Camden County during the time period in which she lived, and draw their conclusions based on that information, not strictly on family tradition.
