Be it known to all men by these presents that I William Charles of the place afsd. being sick & weak of body but of perfect sence and sound disposing memory. Therefore calleing to mind the mortality of my body and knowing that it is appointed once for men to die do make and ordain these presents to contain my last will & Testament in the following manner & form that is to say–

Item   I give to my loving wife the use of the whole land plantation & improvements that I now dwell on for the term of fifteen years and from the end of that time one third of the afsd. land plantation & improvements during her natural life to her and her disposal.–

Item   I give to my two sons William Charles & Joshua Charles all the land & improvements that I now dwell on to be equally divided betwixt  them  and their heirs for ever but if either of the sd. Wm. or Joshua should die under age the other to have the whole land & improvements.–

Item   I give to my brother in law John Henby thirty two acres of land lying between the gum swamps (now in hands of Foster Tomes ) to him and his heirs for ever–

Item   I give to my son Aaron Charles the uper half of all my land between the gum swamp (that I had of Jno. Pinner & that in the hands of Foster Tomes) to him and his heirs for ever–

Item   I give to my son John Charles the other lower half of my land between the gum swamp (that I had of Jno. Pinner & that in the hands of Foster Tomes) to him and his heirs for ever.–

Item   I give to my daughter Margaret Charles one feather bed and furniture to her and her disposal when arived to age or marriage–

Item   I give to my daughter Anne Charles one feather bed and furniture to her and her disposal when arived to age or marriage–

Item   I give to my loving wife all the residue and remaining part of my estate that is not already given away to her and her disposal for ever–

Further more I nominate constitute and appoint my loving wife Jane Charles Executrix and my father in law Aaron Albertson Executor of this my last will and Testament and I do hereby revoke and disanulall and every other wills and testaments and bequests and Executors by me in any wise before this time named willed and bequeathed ratifying and confirming this and no other to be my Last will and Testament–

Know all men by these presents that I Nathaniel Albertson, Farmer of the place aforesaid being very sick & weak of body but of sound disposing mind and memory thanks be given to God therefor, and calling to mind the mortallity of my body and knowing that it is appointed for all men once to die do make and ordain these presents to  contain my Last will & Testament in manner & form following

(Viz) Principally & first of all I give and recommend my Soul into the hands of God that gave it, & my body to the Earth to be buried in a Decent & Christion manner at the discretion of my Executor hereafter named: And as touching such worldly estate wherewith it hath pleased God to belss me in this life, I give & dispose of the same as follows,

First I will that all my just debts be  Defrayd & paid in convenient time after my Decease by my Executors hereafter named

Item.  I give to my Son Joshua Albertson all of my Land  from Long Branch down to the Creek Swamp and so down to the branch at the upper end of my Mannor Plantation & so out to the back line to him & his heirs for ever, also one feather bed & Furniture on which I lie, also the one third part of all my stock of cattle & hogs to him & his disposial.

Item.  I give to my Son William Albertson my Mannor Plantation I now Dwell on with all the Land from the aforementioned Branch at the upper end of sd. Plantation, running with a direct course with the Branch from the Creek Swamp to the back line & thence down to the line of that Land that was former by his Grandfather Samuel Nicholsons, to him and his heirs for ever, Only my will & desire is that my Daughter Hannah Albertson have the liberty of  the use of my non Dwelling Houses as long as she shall remain unmarried  Also I give to him the one third part of all my stock of cattle and hogs to him & his Disposal Also one Negrow woman named Joan with what issue she may here after happen to have to him & his heirs lawfully begotten of his body them failing then to return to the Heirs of my body; Also I give to my Grandsons  Benjamin & Chalkley Albertson, Sons of William one young Negrow boy named Abraham, to them & the heirs of their bodies them failing then to return to the Heirs of my Body

Item,  I give one Negrow girl named Rose she and her increase to my Son Joshua & Daughter Hannah Albertson to be equally divided betixt them But if it should so happen that my Sd. Daughter Hannah should Depart this life without heirs of her body Lawfully begotten  then my will and intent is that the Sd. Negrow and her increase shall return to my Sd. Son Joshua & his Heirs

Item   Give to my Said Daughter Hannah Albertson one third part of all my sheep, Also one featherbed & furniture also one chest to her & her disposal

Item,  I give to my Daughter Elizabeth Newby one Barrell of Pork   to her & her disposal

Item   I give to my Son Aaron Albertson one hundred weight of fresh Pork and also the one third part of all my stock of hogs & Cattle to him & his disposal—

Item   I give to my Daughter Lydda Trueblood  one third of all my sheep to her & her heirs

Item   I give all the rest of my personal estate to my Son William Albertson to him & his heirs for Ever

Item,  Also I constitute and appoint my three sons, Viz. MAUDLIN

  • Ezekiel Maudlin, first in Perquimans, came from London, according to family tradition. This name does not appear on any of the records of the Lower counties in Virginia, neither do the Quaker records show a person of this name. So the opinion is advanced, that he came straight from England to Perq, or landed first in New England, where he m Hannah Nicholson (d of Christopher, & Hannah —, b Mch 4, 1667). It is positively known that Christopher Nicholson came to Perq from New Eng, where he had already m Hannah Rednap. The names & ages of his children are recorded in Berkeley Par Reg, but his marriage is not mentioned.
  • Ezekiel Maudlin, & wife Hannah, issue: 1 Edward, b Feby 11, 1695—2 Ezekiel, b April 2, 1698—3 Mary, b Mar 2, 170-1—4 Elizabeth, b Nov 20, 1703—5 Sarah, b April 28, 1706. Ezekiel Maudlin died Mch 16, 1705-6. (According to the Roman Calendar.)
  • Hannah (née Nicholson) m 2d Charles. Her will p in Perq Co, July 1752, names son: Edward Moudlin, dau’s Elizabeth White, Sarah Perry, & Ann Cox (son-in-law Robert Cox), gr-sons: John Moulin, & John Cox, gr-dau Mary Moulin (d of John).
  • Ezekiel Maudlin grt for land in Perq, June 20, 1703, which he conveyed to Timothy Clare, April 26, 1705. (Deed book F, No 60.) He evidently died intestate, as no will appears in Perq, made by him.
  • Hannah Maudlin (above) was 2d wife of Samuel Charles Sr, he had for 1st wife Elizabeth, by whom he had issue, d Elizabeth. (See Charles record in this book.)
  • Ezekiel (2) Maudlin, m Hannah Toms (d of Joshua, & Sarah née Gosbey, b June 6, 1706), issue: 1 Jeremiah, b Aug 21, 1725—2 Joshua, b Apl 19, 1727—3 Edward, b Apl 7, 1735. Hannah wife of (2) Ezekiel m 2d Edmund Chancey. (2) Ezekiel Maudlin, in his will p in Perq April 17, 1732, names sons: Jeremiah, Joshua, & James, wife Hannah. His son Edward is not named for some reason, & as Edward b April 7, 1735, was born 2 years after the death of sd Ezekiel, we do not see how he could have been one of his sons. He is certainly given in Berkeley Par Reg, however, as “son of Ezekiel, & Hannah.” (Probably the 2d Ezekiel & Hannah Toms.)
  • Sarah Maudlin was a legatee in the will of Samuel Charles, Mar 12, 1727-8. (3) Ezekiel Maudlin, is thought to have m 1st Hannah — & had Edward, b April 7, 1735; he m 2d Mary — issue: 1 Elizabeth, b July 13, 1738—2 Sarah, b March 20, 1741. Ezekiel Maudlin was “Overseer of the Roads” in the district of John Perisho Apl 1740. The division of Ezekiel (2) Maudlin Est, 1737, shows Hannah as his wife, sons: Jeremiah, Joshua, & Thomas.
  • Among Tithables; May 25, 1743, Edward Modling, Edward Jr, Wm Modling, & Ezekiel Maudlin. Tithables 1768; Mary Modlin, & son Ezekiel, Edmund Modlin, Jacob Elliott & Joseph Draper.
  • Hannah Chancey, & Thomas Weeks, made petition to the Court, Jan 1736, for a division of the Est of Ezekiel Maudlin Dec’d.
  • Mary Maudlin widow of Ezekiel, July 1746, John Maudlin petition to sell perishable Est of sd dec’d. Jan 1754.
  • Edward Maudlin, in a deed Oct 15, 1739, called Thomas Nicholson “cousin.” He bought of James Henby Jan 24, 1735, 150a of land, “near the head of Vosses Creek.”
  • (1) Edward Maudlin (Ezekiel (1) m Mary — issue: 1 John, b May 26, 1718—2 William, b Feb 27, 1721-2. He was dead Jan 19, 1754, when John Maudlin petitioned the Court for liberty, to sell pt of his Est, which was done Feb 7, 1754.
  • (1) Thomas Maudlin, will Perq, Nov 16, 1758, names wife, Sarah, son Jeremiah, brother Edmund Chancey, father-in-law John Clayton, bro-in-law Richard Clayton.

  • John Modlin moved from Perq, to Back Creek, Randolph Co, date not known.

  • Edward Maudlin m Sarah Ashley, widow, before July 1745, when an Order of Court was rendered them, to sell Est, & divide with the Orphans.

JONES

  • As everyone knows there are Jones, and then Jones. While it is extremely difficult to decide with absolute certainty the descent of any line of this numerous family, and one is often very much confused by their many Johns, & Peters, yet we can with good grace give the various Peters in Perq with well founded authority. They are well defined on the records, but no mention is made of the place from which they came.
  • Jones, Peter (1) died in Perq Aug 4, 1679. As he made no will, nothing further can be found. It seems reasonable to suppose that the next by that name was his son. Also it seems probable that there was some connection by marriage, or otherwise, between the Jones’ family, & Robert Beasley, where said Peter Jones was buried. He was probably one of the Peter Jones descended from Abraham Jones, of Va, but there is no positive proof of this fact.
  • (2) Jones, Peter (2) Peter (1), m Elizabeth —. Issue: 1 Rebecca b Mar 14, 1694—2 William, b Sept 28, 1697—3 Peter, b May 7, 1700, Peter Jones, m 2d Mary Overman, issue: Elizabeth, Margaret, Sarah, John, Hannah, & Mary.
  • His will p in Perq, April 1752, names children: John, to whom he bequeathed “plantation whereon I now live” & land at “Mile Branch.” To son William he left 170a, son Peter “plantation whereon I now live” dau’s: Mary, Hannah, & Margaret Jones, Sarah Sutton, Rebecca Denman, gr-son Thomas Sherwood, Exrs son John, & dau Mary.
  • The division of Mary Jones estate (d of Peter) Jan 1, 1758, makes plain the fact that he had two wives. Heirs of Mary Jones dec’d:

  • By this division the marriages of the daughters are disclosed.

  • (2) Jones, William (1) Peter (1), m Priscilla Toms (d of Francis Jr, & Margaret Boge) issue: William, b Apl 27, 1732, d Mch 20, 1753, age 19 years. He was living when his father made his will, p in Perq, April 1752, naming, son William, dau Elizabeth Barber, & Rebeckah Jones, Exrs: Peter Jones (brother) & Moses Barber (son-in-law). As this son died the following year in young manhood, it seems probable that he died unmarried, therefore we are led to believe that William Jones had no male descendants in Perq.
  • Jones, Peter (3) will Perq p April 1753. Sons: Thomas, Zephaniah, Zachariah, Malachy (land on Mile Branch) dau Mary, wife Mary, gr-son Joseph Jones. Peter Jones Estate was divided Aug 1, 1758, among the several heirs; James Elliott received £81-11-9 “in Right of his wife Mary,” Zephaniah, & Malachi Jones same.
  • The division of Mary Jones Estate, July 1758, a “part to Joseph Jordan, in right of his ward Joseph Jones,” other heirs: Thomas Jones, James Elliott “in right of his wife” Zephaniah Jones, Malachi, & Zachariah Jones, each a part. In this division Thomas Jones is said to be the “eldest son of Mary Jones, who died intestate” April 18, 1758.

  • Jones, Joseph (2) Joseph (1) m Mary—issue: 1 Joseph (3), b 22, 11mo 1803—2 Huldah Bundy Jones, b 1, 2mo 1811. Mary Jones died 14, 10mo 1813.

Sons: Thomas, William, Zachariah, daus Mary Newby, & Sarah Jones, wife Margaret (nee Toms).  –This Thomas Jones was evidently the father of William, of Jones Farm across “Jones Bottom” whose will was p Aug 1794, he being son of Peter (3) and Mary Pierce.

  • Jane Charles had a grt for land in Perq 200a on “Southwest side of Western Branch of Yawpim Creek, at a branch that divides sd land from Robert Harmon,” Apl 1, 1694. She appears on the Rent Roll of Perq, prior to 1700, with 287a of land. The records do not make plain exactly who this Jane Charles father was. She is named in two of the Charles wills, as a sister. She died d. s. p. 1688.

  • William Charles made his will (Co not given, but certainly in Perq) dated April 7, 1687. He bequeathed to brother John 120a of land, & to dau Jane “plantation I now live on” wife Elizabeth. Ex Francis Tomes (father) step-father, & Jonathan Philips (Phelps). All of Perq County.
  • Daniell, Charles, d. s. p. (will Perq) April 17, 1687, names brothers: John, & Samuel, sister Jeane. Ex Francis Tomas (Toms) & Christopher — (Nicholson).
  • John Charles, also d. s. p. His will not dated & no Co given, names brother Samuel.

  • Samuel Charles will Perq Co, p Mar 1728, names son Samuel, to whom he left a plan’ “on which I live” son John “land on Gum Swamp” son Josuay same, dau’s Lidey, Sarah, & Hannaugh Charles. Gr-dau Elizabeth Overman.
  • Hannah Charles, who was 2d wife of Samuel Charles, also made her will in Perq, p July 1752. She names son Edward Moulin, & dau’s Elizabeth White, Sarah Perry, & Ann Cox, son-in-law Robert Cox, gr-dau Mary Moulin, (d of John), & gr-son John Moulin. (She was d of Joshua Toms, m 1 Ezekiel Maudlin, 2 Samuel Charles.)
  • William Charles (s of John, b 1738) will Perq p Jan 1771. Sons: William, Joshua, Aaron, & John, bro-in-law John Henby, wife Jane, d Margaret, father-in-law Aaron Albertson, Ex.
