          No. 240: Christopher Gale, John Lovick, & William Little, Esquires; Exors, & Trustees Apt’ in the last will of Henry Clayton, late of Chowan Pre’ct, Esq; said will Jan 20, 1725/26, “did bequeath to them” his Plan’ in Perq, called the “Vineyard”, for the use of his Dau’ Sarah Clayton & did empower them to sell same: One Abraham Sanders being the Highest Bidder do sell same for £400 “where Henry Clayton formerly lived”, being two thirds of 640a Patented Feb 6 —- One Half bought by Major James Coles Dec’d of Wm Fryley, & Grace his wife, & by said James Coles in his will “divided between his dau’ Elizabeth & his wife Mary’ & was by Henry Clayton purchased of Wm Hall of Perq. Book D, No. 101: Thomas Houghton, of Chowan, & Elizabeth, his wife, dau of Jonathan Evans dec, for £100 paid by Richard Skinner, Abram Sanders & Zachariah Nixon, (all of Perq), planter–, & John Wilcocks, of said Co., Millwright–sold 150a on Southeast side of “Castletons Creek,” up Creek Swamp, between Thomas & his brother William Houghton, “a dividing line between Peter Joses Jun, & the Orphans of John Williams dec,” over a Branch called “Beaver dam Swamp” formerly belonging to “Jonathan Evans, father of said Elizabeth,” April 18, 1743.           No. 133: Zachariah Chancey of Perq sold unto Abraham Sanders, of afore’ one negro boy named Cato, aged two years, for £100 “in open market.” Jan 7, 1746. Test’ Rt Wilson, Stephen Chancey.

          No. 134: N.C. July Court 1748. Present his Majesties Justices. “Bill of sale of a negro boy Cato was assigned over by Abraham Sanders, to Mr. Luke Sumner.” Edmund Hatch Clk Ct.

Book F, No. 155: Moses Elliott, & Judith his wife, of Perq, for £20 pd by Moses Barber , of afsd–sold 98a. 47 of which was grt to Abraham Sanders dec’d & 41a a new patent , sd land “bequeathed to sd Judah Boice.” April 22, 1755. Test’ Francis Robbins, William Skinner.

          No. 176: Abraham Sanders of Bladen Co. NC for £33 pd by William Lamb of Perq, sold 190a on So Wt side of perq River, between lands of Charles Jordan & Col John Harvey, to line of John Pritlow. Oct 13, 1755. Test’ Joseph White, Jno Sanders, Jno White. (note: This Abraham was the son of Abraham Sanders & Judith Pritlow of Perquimans County.)

Book G, No. 5: Robert Avery for £25 pd by Zachariah Jones, sold 50a, on “the main road that goeth to Edenton” along line of land bought by Moses Baker, of Moses Elliott, & land formerly Abraham Sanders. Jan 20, 1761. Test’ Joshua Skinner, Sam’l Standin, Zepaniah Jones. 

Booh I, No. 50: William Baker of Perq. for £50 pd by Benjamin Sanders , of afsd—sold 50a pt of land given by Abraham Sanders, to Judith Boyce, & by sd. Judith & Moses Elliott, her then husband, conveyed to Moses Barber, adj land pat’ by sd Abraham in 1749. Seal Jan 19, 1778. Test’ John Stafford. 

 

PHELPS

  • William Phelps came to America, from Tewksbury England in Mary & John, 1630. Tradition has it that Jonathan Phelps, who settled in Perq Co N. C. was an Englishman, but no record has been found, to prove that fact, and where he came from to Perq, can not be certified by any legal papers. The Land books however give the fact that he took up 400a “in ye pre’ct of Perq, on West side of Perq River, and South side of Wilsons Creek, running down the River 116 perches,” 1684. Robert Wilson in a grant to him (same year) names the same Creek, and calls it a “branch” so it was probably a very small stream. This grant is of especial interest, from the fact that it was exactly where the town of Hertford is now located. Seth Phelps was grt “240a in Perq pre’ct, June 24, 1704,” on So side of Albemarle Sound, adj Richard Buttenshall. Cuthbert Phelps had land grt him, 300a in Perq prec’t, on So side of Albemarle Sound, adj John Jennett. (same date). Samuel Phelps took up 150a of land Feb 10, 1718, on S. W. side of Perq River adj Sarah, & Hannah Lilly. It is a well known fact that Henry Phillips lived on the “Point” and Hannah his wife m 2d John Lilly, leaving several children. Old papers in Perq, show that Jonathan Phelps held land in the same locality, and he sold to the Directors of Hertford land to build a town, called Hertford. Jonathan Phelps petitioned the Court July 1755, for “Lycence to keep an Ordinary at his now Dwelling house” which was granted. An Act of Assembly was passed the same year, for “Establishing A public Ferry, from Phelps point, to Newby’s point, whereon the Courthouse Now Stands, on Perq Rier,” and agreed to pay said Jonathan “one of said ferry men £4, and Nathan Newby the Other Ferry man,” the same, for “setting over ferry free Inhabitants of said County at Court times, Elections, Members of Assembly, Vestry men, & Musters, In said County” Security; James Sitterson, Joseph Ratcliff. Jonathan Phelps, and Nathan Newby prayed for their pay, “for Maintaining a Publick ferry, from Phelps Point to Newby’s Point” April 1759, Granted. Jonathan Phelps was dead, July 1759. (Auditors Act.) Dorothy Phelps was granted Admix on Estate of her dec’d husband Jonathan Phelps, April 1759. (Minute book Perq Co.) His Inventory was presented in Court, by Dorothea Phelps, widow, May 20, 1759. Benjamin & Dorothy Phelps Orphans of Jonathan dec’d, in Act with their Guar John Skinner, who intermarried with Dorothy, Relict of sd Jonathan Mar 13, 1761. (Auditors Act.) This Jonathan Phelps was the third in descent, from Jonathan (1) in Perq, whose will was p April 4, 1689. His children are given in Berkeley Parish Reg as follows:
  • Phelps, Jonathan (1) m Hannah — & had issue: 1 Sarah, b Jan 15, 1671—2 Elizabeth, b Apl 2, 1679—3 Jonathan, b Nov 6, 1681—4 Samuell, b Aug 6, 1684 (the first Jonathan evidently died, at what date is not given, but he had a second son) Jonathan (s of Jonathan and Hannah), b April 13, 1687. Jonathan Phelps d Feb 21, 1688/9. His will on date above, is much faded and only the son Jonathan, and wife Hannah names are legible. The son Samuel certainly survived him however many years.
  • (2) Phelps, Jonathan (2) Jonathan (1), m Elizabeth Toms (d of Francis Toms Jr, & wife Margaret Bogue), issue: 1 Henry, b Mch 5, 1724/5—2 Elizabeth, b Aug 29, 1728. His will Perq, p Jan 1732. Sons: Henry, & Jonathan, to whom he left, “my manner plantation” & second, 300a “on Perq River,” dau Elizabeth, wife Elizabeth.
  • (3) Phelps, Jonathan (3) Jonathan (2) Jonathan (1) m Dorothy Jordan (d of Matthew Jordan & wife Dorothy née Newby, of Isle of Wight Co Va) Dorothy Jordans mother, was sister of Gabriel, William, & Nathan Newby, who came to Perq from Nansemond Co Va. She m 2d John Skinner before 1761. (See Auditors Act.) Loose papers, & Minute books in Perq, state plainly Jonathan (3) and wife Dorothy had issue: Benjamin, & Dorothy.
  • (4) Phelps, Henry, (s of Jonathan (2) m Margaret Nixon (d of Zachariah) issue: Jonathan and Elizabeth, named in his will, p in Perq July 1752. These children were still under age Mar 1758, when Elizabeth chose for her Guar, Robert Newby, and Jonathan (s of Henry) made choice of Mark Newby in the same capacity.
  • (4) Phelps, Benjamin, m Sarah, & had according to his will, p in Perq, Jan 1785: Dorothy, Margaret, Sarah, & Mary Phelps.
  • (2) Phelps, Samuel (1), Jonathan (1) will p in Perq, July 1728, Sons: Jonathan, John, William, James. Ex brother Jonathan.
  • Phelps, Samuel (s of Samuel & Hannah, m Elizabeth Toms d of Francis) b Nov 17, 1706—2 John, b Jan 13, 1716/17. John Phelps was of age Jan 1739, and made petition for his Est out of the hands of Zachariah Elton on that date.
  • Phelps, William (1) Samuel (1) Jonathan (1) d. s. p. will probated April 1752. Leg: John, Harvey, & James Sitterson (cousins) William Barker, Sarah Eliot, & Samuel Sitterson.
  • Phelps, Benjamin, petitioned the Court July 1774, for leave to “keep an Ordinary at his now Dwelling house in Hertford,” Which was granted. He served as Justice of Peace in Perq Co, 1778.

ELLIOTT

  • John Elliott, son of Bennett of Nasing Essex England, bapt 1604, arrived in America 1631, and settled in New England.
  • Jacob Elliott, brother of Rev John Elliott the Apostle, who died before 28, 2mo 1651, at which time his will was p in New Eng. He made bequest to son Jacob a “House” and to dau Hannah the same. His Inventory shows wife Margery, and that he had in money £579-23-8, 29, 11mo 1651. Margery wife of Jacob, died Oct 30, 1661, heirs: son Jacob, Theophilus Frary, & wife Hannah, Susannah, & Mehetabel Elliott of Suffolk Mass. (New Eng Hist & Gen Reg, Vol 4-p 257.)
  • Mehetabel Elliott, m Seth Perry of Boston, before 14, 8mo 1662. Her fathers Est was estimated to be worth £280.
  • William Elliott was transported to Va by Frances Yardley, Nov 15, 1648. (Lower Norfolk Co Rec.)

    He was granted land in Gloucester Co Va, 110a, 1672, and appears as a tithable in Surry Co (Sunken Marsh) June 8, 1681. He was probably a brother of Thomas, of Perq Co. John Elliott came to Va as a headright of Richard Jordan of Surry Co Va, Oct 20, 1689. (Surry Co     Rec.) Also thought to be brother of said Thomas.

  • Thomas Elliott (s of Joseph who d 1697) emigrated to Va, with brothers William, & John, date not given. He acquired large landed Est in Carolina, and served in the Assembly 1696. He was granted 555a in Perq Co, Aug 27, 1714 “on ye N. W. side of Crane Ponds” adj Joseph Smith, & Nathan Newby. John Elliott took up 350a in Anson Co N. C. Feb 25, 1754, adj his own land.
  • Elliott, (I) Thomas, m 1 Sarah, issue Lydde, b 6, 12mo 1718. This could not have been his first child, as William his son was m to Elizabeth Relph Dec 2, 1690, or this may probably be his brother William who came to America with Francis Yardley. William Elliott had a son Pritlow who was m in 1744, a long period of time between marriages, but he may have married late in life, or been born ten or fifteen years after this date. There is no certain proof of either point.
  • Elliott, (1) Thomas, m 2d Margaret, who survived him. His will Perq, p Dec 16, 1729. Sons: Caleb, to whom he left “plan’ on which I now dwell” Joshua 200a of land, Isaac the “remaining part of tract,” William 1 shilling, Thomas (2), Abraham, Solomon, Moses, Joseph, Benjamin, Dau’s Mary Brown, & Ursley, wife Margaret.
  • Elliott, (a) Caleb (1) m Mary Winslow.?

Issue: 1 Ephrim, b July 5, 1731—2 Haig (Hange) b Aug 6, 1735—3 Caleb  (2), b Feb 21, 1737—4 Solomon, b Aug 20, 1743—5 Miriam, b Feb 16, 1745—6 Peninah, b Nov 18, 1746, m Joseph Scott, 12, — 1759. Caleb Elliott will p in Perq, Jan, 1777. Sons: Solomon, Ephrim, & Haig, dau Pennah Scott, gr-sons: Elliott Scott, & Winslow Elliott.

  • Elliott, (b) Joshua, m Anne —. Issue: Joshua (2) b Mch 24, 1740. (untraced.)
  • Elliott, (c) Isaac, m Elizabeth Morgan, 18, 1mo 1743. His will p in Perq, April 1789. Sons: Joshua, Isaac (2), Joab, Nathan, dau’s Margaret, Rebecca, Miriam, & Sarah Elliott, wife Elizabeth.
  • Elliott, (d) William, (Thomas (1) m Elizabeth Pritlow, (d of John). Issue: 1 Pritlow (no date), who m Sarah Croxton (d of Arthur) 19, 7mo 1744, m 2d Betty Moore 3, 1mo 1753 and 3d Mary, who survived him. His will p in Perq, Oct 1787. Sons: Pritlow (2), John, Job, Thomas, Jesse, & William, dau’s Rachel, Mary, & Elizabeth Elliott, Leah Jordan, Huldah Elliott, & Sarah Pearson (wife of Jonathan), wife Mary. Rachel Elliott m out of Unity, before 5, 12mo 1787. Mary Elliott, m — Smith before 5, 9mo 1787.
  • Elliott (e) Thomas (2) m Mary Morgan (d of John).
  • John Morgan, who made a deed of gift to her, Jan 12, 1724. (Deed book B—No 192.) He died intestate before July 1752, on which date his Estate was divided, widow Mary Admix, heirs: James, Rachel, Mary, Moses, heirs of son Thomas dec’d, gr-child Ruth Munden.
  • Elliott (f) Abraham, died “without a will” July 21, 1766, wife Miriam relinquished her right of Admix, and Cornelius Moore became Ex. (Minute book Perq.)
  • Abraham Elliott Planter, 1756. (Loose papers.) He figures as a householder on Tax list of James Sitterson 1762, with 330a of land in Harveys Neck. On this list he is called Abraham Elliott Sr. In 1764 he appears on same list with son Joseph.
  • Elliott Abraham (2) m Juliana Wilson (d of Jacob, will Nov 1793) whose will was p in Perq, Feby 1813. Sons: Jonathan W., Benjamin, Ephrim, & Isaac, dau’s Achsah Saint (wife of William), Rachel, Keren, & Cynthia Elliott, wife Juliana.
  • Elliott, (g) Solomon, m Miriam Winslow, issue: 1 Winslow (who had son Exum)—2 Exum—3 Francis—4 Solomon—5 Joseph, b 1775, d 1778—6 Thomas, b 21, 12mo 1779, m three times, d 3, 11mo 1845—7 James, b 1781, m Sarah Toms, 18, 6mo 1807—8 Caleb—9 Haige.

  • Mordicai Elliott (s of Joseph) m Leah Smith, 1, 8mo 1778. His will p Perq, Nov 1816, names Gr-children: Peninah, Kesiah, & Martha Elliott (dau’s of s Charles) son Willis, d Jemima Speight, Lydia, a gr-dau Lydia Elliott, s Barnabas, & Jesse, wife Leah.
  • Lydia Elliott (d of Mordicai) will Perq p May 1823, names brother Willis, nieces: Grizzell Speight, & Mary Ann Elizabeth Speight, (br-in-law Noah Speight).
  • Elliott, Charles (s of Mordicai) lived near Edenton, and was Attorney Gen’l of N. C., he moved to Craven Co, & is buried in New Bern N. C.
  • Elliott (j) Benjamin Thomas (1) m Sarah. Will p in Perq, Apl 1774, Sons: Josiah, Benjamin (2), Seth, Exum, & Obed, wife Sarah.
  • Elliott, Ephrim (1) Caleb (1) Thomas (1) will Perq, p Feby 1802. Sons: Caleb, Miles, Townsend, & Josiah, heirs of s Stephen dec’d: Stephen, & Mary Elliott, dau’s Mary Wood, Peninah, & Avis, gr-sons Thomas, & Ephrim Roberson.
  • His wife who was probably dead when this will was probated, was Sarah, (d of William Townsend, by his first wife) who names her in his will 1766. (See other Elliott wills, N. C. Hist Reg Vol 3-3.)

  • Elliott, Thomas (2) William (1) Thomas (1) m Mourning Wilson, 7, 3mo 1778. (Wellses.) He was dec’d Feb 23, 1797. Heirs: Miles, Abraham, Peninah, & Docton Elliott, wife Mourning Admix. She was dau of Abram Wilson, whose will Perq p May 1795, (names all three of these children, & wife Lydia.) Miles Elliott was Sheriff of Perq Co, 1821. He m Patience Jordan, 1, 10mo 1778.
  • Elliott, Docton, was of age before 1766, appears on Tax list on that date.
  • Elliott, Miles, on same list, with 172a of land in Perq, Harveys Neck. His brother Gabriel on same list, 46a in same District.
  • Elliott, Exum, of age 1792, poll 1, List of James Sitterson.
  • Elliott, Ephrim, owned 256a in District of Jacob Perry 1792.
  • Elliott, Pritlow, 650a “on Sipres Creek” in District of Jacob Perry 1792, sons Job, William, 1771.
  • Elliott, Solomon, 200a called “new neck” in District of Jacob Perry 1792.

IN THE NAME OF GOD AMEN. The 10th. Day of Aprell, in ye year of our Lord, one Thousan, Seven hundred & Twenty nine. I, Thomas Harvey, of ye precinck of perquimens & Province of North Carolina, Gent., Being of perfickt mind & memory, Thanks be to Allmitey God. Thare fore, Calling unto Mind ye Mortality of my Body & knowing yt it is apointed once for all men to Dye, do make & ordain this my last Will & Testement, yt is To Say, Principally & ferst of all, I Recomend my Soul into ye hands of God yt Gave it; & my Body I Recomend to ye Earth to be buread in a Decent & Cristeon maner, at ye Descration of my Exetors. Hareafter named, nothing Doubting but Genarll. Resuration, I shall Receive ye Same aGain by ye Power of Allmitey God; and as Touching Such Worldly Estate wherewith it bath pleased God to bless me with in ys. Life, I Give & Demise & Dispose of ye Same in ye following maner & Forme:

Imprimis. I will & Desire yt as Sune as my Death, all my Just Debts yt in write or Conchinnces I owe To Eney person or persons be Deschard. & payd, with Justes.

Item. I Give to my Dear beloved wife, Elizabeth Harvey, ye one thuerd part of my personell Estate, to be Equally Taken out of ye Hole, both in quantity & Qualety of ye Same, after all my Just Debts are payd. But all Legeaseys to be payd out of ye other Two Thurdes of my Estate.

Item. I Give to my Beloved wife aforesaid, my Negro Man Called Jamey.

Item. I Give To my beloved Wife aforesaid, My Plantation whareon I now Live, dureing her Natrall Life & at hur desse., To be Injoyd by my soun, Thomas Harvey, and his aires for Ever. My Will is, That ye Said Thos. Harvey, shall not be debard or hindread from bulding or leiving on Eney Part of ye Lands so Sune as he Shall arive to ye Age of Twenty one yers, Ye Clear’d land & Dweling house Exceptd.

Item. I Give To my Soun, Thomas Harvey, my Negro Boy, Callead Ned, and my Negro Gall, Called Dinear, to be Injoyd by him & his ares for Ever.

Item. I Give to my Soun, John Harvey, my Negro Boy, called Frank, and my Negro Gall, called Marey ann., To be Injoyed by him & his ares for Ever.

Item. I give to my Son, Benjn. Harvey, my Negro Boy- Callead Willcock & my Negro Gall Callead Hannah, To be injoyd by him & his ares for Ever.

Item. I Give to my Soun, Miles Harvey, my Negro Boy Callead Jack & my Negro Gall Called fates, & my Negro Gall Callead Pegg, To be inJoyed by him & his ares for Ever.

Item. I Give To my fore Souns, namely: Thomas, John, Benj’n. & Miles, My fore plantions or Pasealls of Land; To my Soun Thos. Harvey, My Plantion whareon I now live, after his Mothers Desese as above said, To be in Joyd for Ever; To my soup, John Harvey, My Plantion, CaHead ye Quarter, with ye Lands beLoing thare to, To be inJoyd by him & his ares for Ever; To my Son, Bejn. Harvey, my Plantion Called Foleks Pint, with the Lands belonging thareto, To be Injoyd by him & his ares for Ever; To my Soun, Miles Harvey, all my Lands on Chowan River, ling in Rockahock neck, ye lands I Bought of Samuel Woodard, To be InJoyd by him & his ares for Ever.

Item. I give to my Brother, Miles Gale, of Boston, in Newengland, one Quarter or forth part of the Slupe Called The two Brothers, whare at this Time I own Three partes & he one.

Item. I Give To Each of Collo. Robad Wests Dafters, which he had by my Sester, Marey Harvey, Namely: Mathe, Sarey & Marcy, one Gold Ring, To Each of them, to ye valey of fortey Shillings Each. And likewise Give to my two Sisters, Elizabeth Clayten, and Penelopy Lettell, Wife of Mr. Willm. Lettell one Gold Ring apes, or fifty Shillings each.

Item. I Give to The Children, or so many of them as is now Living, Belonging to ye Wife of James Settersen, & ye Wife of Willm. Tetterten, fortey Shillings a pese, or to ye Valey of ye Said Money in what my Exceters. hareafter named Shall Tink fitt.

Item. I Give to John Cole, Soun of John Coles, of Nances- mun in Virieny, one tree year old Hores.

Item. I Give to Josway Wherey, Soun of Antoney Wherey, one Bed and Furneture, To ye Valey of Tenn pounds.

Item. I Give to Elizabeth Wherey, Dafter of Antoney Wherey, one feather Bed, To ye Valey of Ten pounds, & Ten pounds in Current Money of North Carolina.

Item. I Give one Hundred Pounds, Current Money of North Carolina, To be Emplid & Lade oute for ye youse & benefett of ye pore & pore Children beloing to ye precinck of Perquimons, Such as are Mentanead by ye paresh Excepted out. But ye money to be Ametadatly Layd out at ye Descretion of my Excetr. hareafter namead, but to ye youse aforesaid.

Item. I Give To Mr. Willm. Lettell of North Carolina, & my Friend, Collo. Edward Moseley, & my Friend, Mr. Thos. Pollock, & To Each of Them, one Gold Ring a pesese to ye Valey of Ten pounds, Currant Money of North Carolina, Each Ring to be purched out of my Estate by my Excetrs. hareafter named.

Item. I Give all ye Rest & Residue of my Estate, Both Reall and Persnall, be it in North Carolina or Eleswhere, be it in wot kind or maner SoEver, To my foure Sounes, namely; Thomas Harvey, John Harvey, Bejn. Harvey, & Miles Harvey, To be Equally Sheard & Devided betwene them & To them & thare ares for Ever. And If Either or Eney of Them shall Diye before thay ARive to ye age of Twenty one Years, that then, & in Such Case, that part of ye Estate as beloingd to ye Desesead, to be Equally Devided among ye Sirvivrs & thare ares for Ever, both rell and persnall. And my will is that the Money ariseing out of my Estate, Either by ye Sale of Good, Hire of Negroes, or by Eney ways or menes wot Ever, To be Emplid in Trade or Lett To Entrest for ye Benefett of my Children after an alownces for thare Edecation.

The fift Day of January, In the Year of Our Lord, 1744-5: I, Ralph Boozman, in the County of Perqs., Husband Man, being In good Health and of Perfect Mind and Memory, Thanks be given unto God therefore, calling to mind the mortality of my Body & Knowing that it is Appointed for all men to Dye, do make & Ordain this my Last Will and Testiment: that is to Say, principally, and first of all, I give & Recommend my Soul Into the Hands of God yt gave it; And for my Body I Recommend it to ye: Earth, to be Buried In a Christien like & Decent Manner, at the Discretion of my Exs.
