THE LAST WILL AND TESTAMENT

SOUTHEY FORBES

May 26, 1815

In the name of God Amen. I SOUTHEY FORBES of the County of Camden & State of North Carolina doth this 26th day of May Eighteen Hundred & fifteen make this my Last Will and Testament in the following manner To Wit. Calling to mind the mortality of man & know it is appointed for all men to die.

First. I recommend my Soul to God-who gave it & my body to earth & as touch such worldly goods as it hath pleased God to bless me with I give in the following manner To Wit.

Item. I give the use of all my property both real & personal unto my beloved Wife POLLY FORBES for & during her natural life for her support & she the said POLLY FORBES has liberty to sell my part of the chattle property for decent support at her own discretion, but reserving never the less a sufficient part of said chattle property sufficient to pay all my just debts to be sold by my Executor & of such as my Wife may think she can spare best. It is my will & desire that after the death of my Wife POLLY FORBES that my negro Nelly should not be Hare to any person but be under the protection of CALEB PERKINS & in case he should die then & in that case, she be under the Protection of Baptist Church in Camden known by the name of Schylo, & in case the said negro woman Nelly should out life my Wife, & become sick or old & not be able to work & maintain herself that my Executors are hereby authorised to support her out of my estate.

Item. I give unto CALEB FORBES my Son, all the property which may be at my Wife’s die, both real & personal, except one feather bed & furniture which I give at her death to MORDICAI GREGORY Son of WILL GREGORY Sen. and one negro woman Nelly which I have left in CALEB PERKINS care & of the Baptist Church in Camden as above.

Lastly I nominate & appoint my friend CALEB PERKINS my whole & sole Executor to this my Last Will & Testament revoking all former Wills by me made & owning this to be my Last. In Testimony of the same I have hereunto set my hand & seal the day & date first above written.

In the name of God Amen! I WILLIAM GRAY of the State of North Carolina and County of Camden being of sound mind & memory this 14th day of May 1821 do make this my Last Will & Testament in manner & form following Viz.

Imprimis. I give & bequeath unto my Daughter LENA CHAPLIN one dollar to her & her heirs forever.

Item. I give & bequeath unto my Son PETER GRAY one dollar to him & his heirs forever.

Item. I give unto my Son EDMUND GRAY one dollar to him & his heirs forever.

Item. I give & bequeath unto my Son NATHAN GRAY one dollar to him & his heirs forever.

Item. I give & bequeath unto my Son NATHANIEL GRAY one dollar to him & his heirs forever.

Item. I give & bequeath unto my Daughter SALLY GREAVES one dollar to her & her heirs forever.

Item. I give & bequeath unto my Daughter ELIZABETH GRAY one feather bed & furniture not to be delivered to her till she marries or comes of age to her & her heirs forever.

Item. I give & bequeath unto my Son WILLIAM GRAY one gun to him & his heirs forever.

Item. I lend all the remainder of my estate after paying all my just debts & funeral expences to my Wife POLLY GRAY during her life or widowhood & if she marries I give her one third of the said remainder to her & her heirs forever (with this Promise) that she shall take care of & support the small children (viz) CHLOE GRAY, JANE GRAY, WILLIAM GRAY, & CYNTHIA GRAY till she or they come of age.

Item. I give & bequeath unto my four following children viz CHLOE GRAY, JANE GRAY, WILLIAM GRAY, & CYNTHIA GRAY at the marriage or death of my wife the two thirds or the whole of the said remainder of my estate as the case may be, to be equally divided between them.

Lastly. I nominate & appoint my two friends CALEB PERKINS & MY Wife POLLY GRAY my Executors to this my Last Will & Testament REVOKING ALL FORMER Wills by me made heretofore, In witness hereof I have hereunto set my hand & seal the day & date above written

ELIZABETH GREGORY

March 3, 1823

In the name of God Amen! I ELIZABETH GREGORY being in sound mind & memory but weak in body hath this day March 3, 1823. make this my Last Will & Testament in the following manner.

First of all I recommend my Soul to God who gave it me and my Body to the earth from whence it come. And as Touching such worldly goods as it hath pleased God to bless me with I give in the following manner to wit.

Item. I gave and bequeath unto my four Sons ISAAC GREGORYDORRIS GREGORYNELSIN B.GREGORY, and CASIN M. GREGORY all that land and plantation where in I now live to be equally divided between them, share and share alike to them & their heirs.

Item. I give my Son ISAAC GREGORY one Roan horse Callia(?) his to him & his heirs forever.

Item. I give & bequeath unto my Son DORRAS GREGORY his choice in the spring the old mare or the colt which she is now with fold with—and I give my Son NILSON B. GREGORY the other after his Brother takes his choice and the colt to stay with the mare until weaned at the expence of my estate.

Item. I give my Daughter POLLY GILBERT one linnen wheel that is to say the use of it.

Item. Give unto my Grand Son FRANKLIN GILBERT 1 feather bed & furniture one cow & calf, but her mother to have the use of both.

Item. I give my Son FRANCIS MITCHEL one looking glass to him and his heirs.

Item. I give my Son JOHN MITCHEL four bushels of wheat to him & his heirs.

Item. I give my Daughter ANN GREGORY four bushels wheat to her & her heirs.

Item. I leave all the balance of my estate to be sold by my Exec. At private sale, and after paying all my just & lawful debts the balance to be applied as follows

First for my three children to have a quarters schooling each, and I want my Son ISAAC GREGORY to purchase one & half acres of land for the use of my Grand Son FRANKLIN GILBERT but his Mother to have the use of it her life and the balance to be equally divided between my four Sons ISAAC GREGORYCASIN M. GREGORYDORRAS GREGORY, and NELSON B. GREGORY share & share alike.

Lastly I nominate my Son ISAAC GREGORY & my friend CALEB PERKINS my whole & sole exec. To this my Last Will & Testament.

ISAAC LAMB (1825 Will)

THE LAST WILL AND TESTAMENT

OF

ISAAC LAMB

March 20, 1824

In the name of God Amen, I ISAAC LAMB of the State of No. Carolina and County of Camden being of sound disposing mind and memory blessed be God, and calling to mind the certainty of death and the uncertainty of the time when it will come, and being willing to dispose of my worldly substance, that it has pleased God to give me, at my own will and desire do this 20th day of March 1824 make and ordain this my Last Will and Testament, in the following manner that is to say.

First, I lend unto my beloved Wife POLLEY LAMB the use of all the lands on which I live and the lands I bought of JOHN WILROY and Wife, for and during her natural life and no longer, I also leave her the use of negros David, America, Bill, Susan and girl Nancy and five beds and furniture her choice, and also as much of my household and kitchen furniture, flax, cotton, spin stuff, cloth of homespun, plantation tools utensils and harnis as she may chose to retain for herself and family, all my hogs, four cows and calves a yearling one yoke of oxen, three dry cattel, ten head of sheep her choice, one horse Practier one horse Skip my joubell(?) chair and harnis, and my waggon, and one year’s support for her self and family to be sett off by herself and my two Sons ISAAC and LUKE at there discretion out of the provisions on hand, for and during her natural life and no longer except the provisions, I also give her two hundred dollars in notes on hand for my negro hire.

Item. I give and bequeath unto my Son LUKE G. LAMB a tract of land I bought of JAMES M. GRANDY to him and his heirs forever, I also give him one negro man Davis that I bought of him, one negro man Latchem, and the balance of my swamp up the river called Prichard’s Juniper to him and his heirs forever.

Item. I give and bequeath unto my Son ISAAC N. LAMB a tract of land laying on the Eastwardly side of the main road it being part of the lands I bought of JOHN WILROY and Wife joining the lands of MALICHI SAWYER and others reserving the use to my Wife as aforesaid as also negro Robin, horse Jack, and negro David after the death of my Wife to him and his heirs forever.

Item. I give and bequeath unto my Son LUKE G. LAMB all the lands contained in the deed from my Father to me in my last purchase from him where ABNER SAWYER now lives, in trust to be rented out by him and the rents and profits to be aplied to the use and support of HENRY N. LAMB and his children at the discreation of said LUKE G. LAMB, and at the death of said HENRY N. LAMB the said lands to be equally divided between his lawful children that may be then living, if any but if said Son HENRY should leave no lawful children at the time of his death, my will is that the said land should go to my Grand Son ISAAC N. LAMB, son of LUKE G. LAMB if he should be then living, if not to the said LUKE G. LAMB and his heirs forever.

Item. I give unto LUKE G. LAMB in trust for the benefit and support of ALLEN J. LAMB one negro man Ned or Edmond and all the property that has fallen to me by the death of my Brother THOMAS LAMB, and a small piece of land I bought of FREDERICK GRANDY and his Mother, all which said property is to be mannaged by the said LUKE G. LAMB to the best advantage for the benefit of the ALLEN J. LAMB and his family, and the said LUKE G. LAMB is at liberty to sell any part or the whole of said property for the purpose aforsaid if he should think it most beneficial to do so.

Item. I give and bequeath unto my Daughter CYNTHIA L. HALL one negro man Lamb and his Wife Tamer and there children now in her possession, also one negro man Billa after the death of my Wife to her and her heirs forever.

Item. I give and bequeath unto my Daughter LUCRETIA SAWYER all the furniture she has now in her possession of mine, I also lend her negros Robin, Hannah, Grace and her children for and during her natural life and no longer, and at her death the said negros to be equally divided between her children if she lives any at the time of her death if not my will is that the said negros should be equally divided between ISAAC N. LAMB and ALLEN J. LAMB the said ALLEN’S part to be under the discretion of ISAAC N. LAMB and by him to be delt out to said ALLEN at his discretion and any other wise mannaged as he the said ISAAC may think proper for the said ALLEN and his family.

Item. I give and bequeath unto my Daughter POLLY G. LAMB one half of the lands on which I now live including the swam and pine thickit to the main road the line at ISAAC N. LAMB’S part say one half, reserving her Mother’s life in the same as aforesaid and if my said Daughter POLLY should die without children my will is that the said land should go to her Sister ELIZA H. LAMB, I also give to my Daughter POLLY G. LAMB negros Isaac, Lewis, Jerry, Reading and Judah and negro Nancy after the death of her Mother to her and her heirs forever.

Item. I give and bequeath unto my Daughter ELIZA HALLAN LAMB the other half of the lands on which I live in the same manner I have give the other to her Sister POLLY and if she should die without children my will is that the said land should go to her Sister POLLY G. LAMB reserving the use to her Mother as aforesaid, I also give unto my said Daughter ELIZA H. LAMB negros Mark, Moses, Leani, George son of Susan, girl Estar and man America, at the death of her Mother to her and her heirs forever.

Item. I give and bequeath unto my Son HENRY N. LAMB all the lands on the east side of Williamses Branch that I have not already given away to him and his heirs forever.

Item. I give and bequeath unto my Grandson ISAAC L. HALL Son of my daughter CYNTHIA one negro boy George (Son of Edie) to him and his heirs

Item. I give and leve my negro woman Susan and her future increase after the death of my Wife, to be equally divided between my Son ALLEN and my Daughter NANCY’S children if they leve any at the time of the death of my Wife, but if my Wife should chose to give up the said negro Susan at any time sooner, then and in that case the said negros are to be at the expence of said children.

Item. All the residue of my property not already given away or lent I leve to be sold by my Executors on a credit of six months and the sum arising from the sale to be applied to the payment of my debts and legacies given away in this my Will, say what is lacking in notes on hand and the balance if any to be applied to the use of ALLEN J. LAMB and his family at the discretion of my Executors.

Item. The balance of the movable property I have lent to my Wife during her life, that I have not already disposed of I give unto my two Daughters POLLY and ELIZA after the death of their Mother to them and there heirs forever.

Item. I hereby appoint my Wife POLLY LAMB gardian to my two Daughters POLLY G. LAMB and ELIZA HALLAN LAMB and if any of their negros should behave themselves improperly to be judged of by her, my will is that she should sell them at her discretion and purchase hers in there room and stead of equal value of them as sold and the bills of sale to be taken in the name of the one to whom the negro belonged that are sold, I also impower her to sell any of those loned to her if they misbehave provided she replaces others in there room of equal value to go as they were, nevertheless this power I have given to my said Wife by this claus of my will to clear(?) and end if she should marry, and in that case I hereby appoint after her marriage ALFRED M. GATLIN gardian to my Daughter POLLY G. LAMB with the same powers that was granted to her my (said Wife) I also appoint my Son ISAAC N. LAMB gardian to my Daughter ELIZA HALLAN LAMB after the marriage of my said Wife, with the same powers that was granted to my said Wife.

I hereby nominate and appoint my beloved Wife POLLY LAMB Executrix and my Son ISAAC N. LAMB and ALFRED M. GATLIN Executors to this my Last Will and Testament, acknowledging this and this only to be my true Last Will, in witness whereof I have here unto sett my hand and seale the day and date first above writen.

June 4, 1824

State of N. Carolina Camden County, June 4th 1824 I JOSEPH MORIS doth this day make my Last Will and Testament, first of all I recomed my soul to God, who give it me and my body to the earth, from whence it came, and as touching such worldly good and as it hath pleased God to bless me with I give in the following manner, to wit.

I lend the use of all my land and plantation to gather with all my stock of horses, hogs, sheep and cattle, househould and kitchen furniture and one negro woman Giny and girl Gin’s Daughter unto DINAH SMITH for and during her natural life, but it is my will and desire that the negroes shall not be carried aught of the County of Camden, nor none of the other property lent her, but for her to sell sufficient for her support.

I give unto my Son JOSEPH MORIS after the death of MISS SMITH the land and plantation lent to DIANAH SMITH and also Giny and her Daughter togather with all the chattel property which may be left at her death unto him and his heirs forever, but it is my will and desire that my Executor hereafter be appointed to sell as much of my property as will be sufficient to pay all my just and lawful debts aught of such property as he may think best,

Lastly I nominate my friend CALEB PERKINS my whole and sole Executor to this my Last Will and Testament the day and date first above written.

November 10, 1745

 In the name of God Amen I JOHN TORKSEY of Pasquotank County in the Province of North Carolina being sickly and weak of body but of perfet mind and memory thanks be given unto God for it calling to mind the mortality of my body and knowing that it is apinted for all men to die do mak and ordain this my Last Will and Testement that is to say principally and first of all I give and recommend my soul in to the hands of God that gave it and my body I recommend to the earth to be buried at the descration of my executers and as tuching such worldly estate whore with it hath pleased God to bless me in this life I dispose of in the following manner and form—–

Itom. I give and bequith to my well beloved THOMAS TORKSEY one negro man named Bossen and eight burels of pork thet he owes me and one feather bed to him and his heirs for ever.

Itom. I give and bequeath to my well beloved Son BENJAMAN TORKSEY the plentation that I now live on and all the land thar unto belonging and one feather bed to him and his heirs for ever.

Itom. I give and bequeath unto my well beloved Daughters ELIZABETH and SUSANE — negros if there be to many of my negro woman named Jeane with ??? self and her two childern Pegg and Wappen and thare encrease betwn this and tim of delivery and if not to memey what there is liven at the time and if thare be more then fore of the sead negros my said Dafters to have which fore thay please to them and hares lawfull begotten of thare one bodys and if my childern that are liven and my will and desire is that shall not recive thare said negros nor devide them tel such time my youngest Dafter SUSANE arrives to the age of eighteen years or the day of marrye only my will and desir is that my Daughter ELIAZBETH shall have the use of the sd. negro garl Pegg at the day of marrye tel the time of devition then to be equelly devided between them likewise I give and bequeath my two Daughters each of them a good ??? furniture and a stone jugg at the day of mariage likewise my will and desir is that if ?? are be a negro or negros of the sd. JONES and DOZIER PERKINS before me GEORGE FEREBEE one of the Justices of the Peace in & for the County of Camden on this 9th day of November 1824 & being duly sworn on the Holy Evangelist of Almighty God saith that they heard CHRISTOPHER WHITEHURST (who departed this life on the day & date above) say that it was his will & desire that OLLA PROVERB should have his estate real & personal of every description during her natural life & after paying all his just debts. And then deponents further say that they heard CHRISTOPHER WHITEHURST frequently say that it was his wish that the said OLLA PROVERB should have his estate during her natural life in health at different times.

JOHN WRIGHT, SR.

1813

In the name of God amen. The last will and testament of John Wright senior of the county of Camden and state of N. Carolina made the 3rd day of February 1773 as follows. Principally and first of all I give and recommend my soul into the hands of almighty God that give it to me and my body I recommend to the earth to be buried in a decent christian burial at the discretion of my executor and as touching worldly estate wherewith it has pleased God to bless me in this life. I give and dispose of the same in the following manner and form.

First I leave the use of my manner plantation thereon I now live to my wife Francis Wright during her natural life with all the priviledges to the same belonging. Also I leave the use of all my negroes to my wife during her natural life.

I give and bequeath unto my wife Francis Wright two mares, one horse her choice. Two feather beds and furniture her choice. Four cows and calves, five ewes and lambs, one yoke of oxen, one ox cart and yoke, all the hogs ? ?. The west side of my plantation whereon I now live. One beaufett and all my crockery ware. Two chest, one large oval table, seven windsor chairs, one arm chair, two flage chairs, one large iron pot, one small ditto with hooks, two pot trammels, two washing tubs, four pails, one churn, one large honey tub, three ploughs and harness, two axes, one large and four small hoes, one powdering tub, four pork barrels, one barrel with fat, one loom and harness, five linen wheels, one copper tea kittle, one hand mill, one walnut stand, one looking glass all her choice. Thirty barrels saune corn, three barrels salt pork, five hundred pounds bacon, fifteen bushells wheat, one side saddle. Also three negro women Judah, Patience and Aleaph to her and her heirs forever.

I leave the use of one certain piece of land known by the name of The Pand to my grand daughter Sally Bell Downing her natural life and to her heirs. If any lawfully begotten of her body and if the said Sally Bell should die without an heir lawfully begotten of her body. Then my desire is that the aforesaid land br equally divided between John Wright and Gamiel Wright sons of Mathais Wright and John Wright son of Peter Wright dec’d to them and their heirs forever. Also I leave the use of two feather beds and furniture, three cows and calves, four ewes and lambs, seven windsor chairs, one armed chair to my grand daughter Sally Bell and her heirs lawfully begotten of her body. And if the siad Sally Bell dies without an heir lawfully begotten of her body. Then the aforesaid things last mentioned to be equally divided between John Wright and William Wright sons of Gamiel Wright dec’d and John Wright son of Peter Wright dec’d and John W. Berry son of James Berry to them and their heirs forever.

Also I leave use of two negroes to my grand daughter Sally Bell Downing her natural life to her heirs if any lawfully begotten of her body forever. The names of the negroes Betts and Patience and provided the said Sally Bell should die without an heir lawfully begotten of her body. Then the aforesaid negroes to be equally divided between John Wright and William Wright sons of Gamiel Wright dec’d and John W. Berry son of James Berry and Alexander W. Gandon to them and their heirs forever.

Also I leave the use of one hundred and fifty acres of swamp land lying down the river binding the river and sound to my grand daughter Sally Bell and her heirs if any lawfully begotten of her body forever and for want of such heirs. Then for the said land to be divided in the same manner and between the same heirs as is mentioned in the clause last before this. To them and their heirs forever.

I give and bequeath unto Cornelius Wright son of Cornelius Wright dec’d fifty acres swamp land binding his plantation and bearing towards the sound so far as will make the same to him and his heirs forever.

I give and bequeath unto Elizabeth Hughes daughter of William Hughes Jr dec’d one feather bed and thirty pounds current money to her and her heirs forever.

I give and bequeath unto John W. Berry son of James Berry one certain piece of land known by the name of The Ridge binding north river swamp containing fifty acres to him and his heirs forever. Only observing that if the said John W. Berry should die without an heir lawfully begotten of his body for the said land to be equally divided between his two brothers namely Batson B. Berry and Jesse B. Berry to them and their heirs forever.

Also I give and bequeath unto John W. Berry one negro man named March to be delivered to him at the death of my wife Francis Wright to him and his heirs forever.

Also I give the said John W. Berry all the cattle that I hold in my possession which is marked posslan leaf in both ears and a whole cut in each ear.

Also I give the said John W. Berry fifty pounds current money to him and his heirs forever.

I give and bequeath unto William S. Berry fifty pounds current money to be raised out of my estates to him and his heirs forever.

I give and bequeath unto Alexander W. Gandon son of Thomas Gandon one negro boy named Ishmal to be delivered to him at the death of my wife Francis Wright.

Also I give the said Alexander W. Gandon son of Thomas one coalt by the name of Black to him and his heirs forever.

I give and bequeath unto John Wright son of Gamiel Wright dec’d one negro man named Lamb to be delivered unto him at the death of my wife to him and his heirs forever.

I give and bequeath unto William Wright son of Gamiel Wright dec’d one negro man named Jess to be delivered to him at the death of my wife to him and his heirs forever.

I give and bequeath unto John Wright son of Gamiel Wright dec’d and John Berry son of James Berry one hundred acres of swamp land lying in north river swamp binding Jacob Cartwrights line thence extending out to Merrels patent. And also ten acres of land known the Great Island binding Tully Cartwrights line. The aforesaid land to be equally divided between the two last names, heirs to them and their heirs forever.

I give and bequeath unto John W. Berry son of James Berry one small piece of land by the name of Paston paint near the old wharf. Also I give the said John W. Berry one young mare to him and his heirs forever.

I leave the use of the land and plantation whereon I now live to my grand daughter Sally Bell and to her heirs lawfully begotten of her body. Altogether after the death of my wife Francis Wright and if the said Sally Bell should die without an heir lawfully begotten of her body. Then I give the aforesaid land and plantation to John Wright and William Wright sons of Gamiel Wright dec’d to equally divided between the two of them and their heirs forever.

My will and desire is that all the remaining parts of my estate which I have not given away or named off in legacies should be sold and after paying my just debts. That the ballance of the money should be equally divided between my wife and John Wright and William Wright sons of Gamiel Wright dec’d and my grand daughter Sally Bell and provided the said Sally Bell should die without an heir lawfully begotten of her body. Then her part of this legacy to be equally divided between John Wright and William Wright sons of Gamiel Wright dec’d to them and their heirs forever.

And also my will and desire is that all the property that I have left the use of to grand daughter Sally Bell. Except the land and negroes should be sold when the rest of my estate is and to be kept in the hands of my executor at interest for her with the land and negroes paid for them. My executor to deal out to her for her support such part of the same as they may think neccessary at their own discretion until she marries and has lawfull heir or dies.

Lastly my will is to nominate and appoint my trusty friends Mathias Wright and Caleb Perkins executors to this my last will and testament utterly revoking and disannulling all former wills by me before made ratifying and confirming this to be the last will and testament which I have made. In witness whereof I hereunto set my hand and seal, date first mentioned.
