DANIEL CARTWRIGHT (1822 Will)

THE LAST WILL AND TESTAMENT

OF

DANIEL CARTWRIGHT

August 25, 1819

State of North Carolina

Camden County

In the name of God Amen. I DANIEL CARTWRIGHT of the County & State aforesaid being of perfect sound disposing mind & memory thanks be to God do make this my Last Will & Testament in the following manner (to Wit.)

Item 1st. I give unto my Wife POLLY CARTWRIGHT all the property that she had at the time of our marriage that I could have taken or been benefited by, unto her & her heirs forever.

Item 2d. I give devise & bequeath, unto my Son NEILSON CARTWRIGHT a small piece of land containing about eight acres more or less lying on the east side of the main road & in the north side of a large ditch, beginning at the road, at the arch over said ditch then binding said ditch to JAMES O. (Carteneg is marked out) SMITH’S line, then binding JAMES O. SMITH land to the road, then binding the road to the first station. Also negro boy John, the one half of negro Ceasar, one feather bed & furniture, one gun, one riding chair & harness, one beaufat, one hand mill, one bay horse, two hundred dollars in promissory notes, which is on hand to him & his heirs forever.

Item 3d. I give, devise & bequeath unto my Son JAMES CARTWRIGHT all the remainder part of my lands, also negro Isaac, the one half of negro Ceasar, one walnut dining table, one large looking glass, one feather bed & furniture, one mare, bridle & sadle, one gun to him & his heirs forever.

Item 4th I give unto my Daughter POLLY SMITH, one cow & calf & all the property I have heretofore given, that she has in her possession to her & her heirs forever.

Item 5th I give unto my Daughter BETSEY RICHARDSON, one cow & calf & all the property heretofore given her which she has in possession to her & her heirs forever.

Item 6th I give all the remainder of my property not heretofore given away to my two Sons NIELSON CARTWRIGHT & JAMES CARTWRIGHT to be equally divided between them share & share alike after paying all my debts, to them & their heirs forever.

I hereby nominate & appoint GEO. GEREBEE and my Son NEILSON CARTWRIGHT Executors to this my Last Will & Testament hereby revoking all wills or bequeaths heretofore made. In testimony whereof I have hereto set my hand & seal this 25th day of August in the year of our Lord Eighteen Hundred & nineteen.

THE LAST WILL AND TESTAMENT

JOSEPH MORIS

June 4, 1824

State of N. Carolina Camden County, June 4th 1824 I JOSEPH MORIS doth this day make my Last Will and Testament, first of all I recomed my soul to God, who give it me and my body to the earth, from whence it came, and as touching such worldly good and as it hath pleased God to bless me with I give in the following manner, to wit.

I lend the use of all my land and plantation to gather with all my stock of horses, hogs, sheep and cattle, househould and kitchen furniture and one negro woman Giny and girl Gin’s Daughter unto DINAH SMITH for and during her natural life, but it is my will and desire that the negroes shall not be carried aught of the County of Camden, nor none of the other property lent her, but for her to sell sufficient for her support.

I give unto my Son JOSEPH MORIS after the death of MISS SMITH the land and plantation lent to DIANAH SMITH and also Giny and her Daughter togather with all the chattel property which may be left at her death unto him and his heirs forever, but it is my will and desire that my Executor hereafter be appointed to sell as much of my property as will be sufficient to pay all my just and lawful debts aught of such property as he may think best,

Lastly I nominate my friend CALEB PERKINS my whole and sole Executor to this my Last Will and Testament the day and date first above written.

State of Tennessee, Fayette County, Jan. 30, 47

For and in consideration of the sum of two hundred dollars to me in hand paid receipt of which is hereby acknowledged. I have this day bargained and sold and do by these presents, bargain, sale, convey and confirm unto Timothy C. Smith of the county of Camden and state of North Carolina all my right title and interest in and to the following property to wit, one tract or parcel of land lying and being in said county of Camden and state of North Carolina the same being part and parallel of a certain tract of land in the southern part of said county or thereabout and lately divided among the heirs of John Wright dec’d in said county. Said heirs being Nathanial Wright, John Wright, Peter, Margaret and Phebe Wright and myself. And being the part allotted to me as one of the heirs aforesaid, as a aforesaid, and containing 25 acres more or less to have and hold to the said T. C. Smith his heirs in free simple forever, and the title to the same to the said Smith his heirs. I will warrant and defend against the lawful claim of any and all persons whatsoever. Also all my right, title and interest in any and all moneys. Moneys, lands of bond for money, sale of notes and all other the like funds to me due and owing from my late guardian in said county of Camden is his executors as any the legal representatives of my said guardian Corton Sawyer. With full authority the same to demand and receive and receipt for the same of and to any the executors or other the legal representatives is representatives of my guardian aforesaid to whose hand has or may come any money is bonds to me due and giving as aforesaid. To have and hold said money to proceed to the only proper use and behoof of him the said Smith, his heirs assign.

In testimony of all which, as well of the conveyance of the lands of the funds aforesaid witness my hand and seal this thirtieth day of January AD 1847.
