Know all men by these presents that I, CHARLTON YELLOWLEY of Northampton
County for & in consideration of the sum of Seven hundred & seventy five
Dollars which I justly owe DAVID CLARK, I the said CHARLTON YELLOWLEY
have bargained, sold, & conveyed & do hereby bargain, sell convey unto
the said DAVID CLARK & his heirs forever the following property of nine*
Negroes to wit BILLY, SURRY, CHARLES, JACOB, OLIVE, BETTY, MILLEY,
MIRT, upon trust nevertheless that if I the said CHARLTON YELLOWLEY
shall well & truly pay to the said DAVID CLARK the aforesaid sum of
seven hundred & seventy five dollars with the interest may be due
thereon on or before the first day of October next together with any
other sum which the said DAVID CLARK may hereafter advance for me the
said CHARLTON YELLOWLY then in that case these presents and everything
herein contained to be void otherwise the said DAVID CLARK his Executors
or assigns shall or may at any time after the said first day of October
next expose public sale to the highest bidder for ready money ongoing
ten days previous notice the said property of nine Negroes as herein
before named and out of the proceeds of said sale pay himself the debt
due him as already expressed and the residue if any to be paid to me the
said CHARLTON YELLOWLEY or my proper representative, and be it further
known that is agreed understood between the said CHARLTON YELLOWLEY &
the said DAVID CLARK that the Negro slaves herein conveyed are to be
remain in possession of the said CHARLTON YELLOWLEY until the day of
sale or day the sale shall be made of them and I the said CHARLTON
YELLOWLEY covenant to produce them the said Negroes on the day of sale
and I the said CHARLTON YELLOWLEY warrants the title of said slaves
shall be remain in said DAVID CLARK & his assigns forever. Witness my
hand & seal this this 15 day of May 1821.
