The last will and testament of G. W.
Whitmire of the state and county aforesaid. I,
G. W. Whitmire, this day give and bequeath all
my property, goods, and chattels, lands, and
_____ to my wife, Elizabeth (to wit) the home
tract of land whereon I now live containing one
hundred acres with all the appurtenances
thereto, also another tract of land containing
sixty acres bounded by the lands of J. D.
Whitmire and Rebecca Whitmire lying immediately
on the waters of Brown's Mill Creek and joining
the home tract above names, also 1 clay bank
horse, 1 black colt 3 years old, also 1 cow
& calf and all other stick including hogs,
sheep, household & kitchen furniture
&c, &c, this 5th day of May 1877,
whereunto I set my hand and seal in [the]
presence of J. B. Galloway & W. F.

A paper writing purporting to be the last
will and testament of G. W. Whitmire, deceased,
is exhibited before me, the undersigned Clerk
of Superior Court of said county, by Elizabeth
Whitmire, the executrix therein named by the
said G. W. Whitmire, is proved by the oath and
examination of J. B. Galloway and W. F. Lee,
the subscribing witnesses thereto, who being
duly sworn doth depose and say and each for
himself deposeth and saith that he is a
subscribing witness to the paper writing now
shown him purporting to be the last will and
testament of G. W. Whitmire, that the said G.
W. Whitmire in the presence of this deponent
subscribing his name at the end of said paper
writing now shown as aforesaid and which bears
date of 5th day of May 1877.
And the deponent
further saith that the said G. W. Whitmine, the
testator aforesaid, did at the time of
subscribing his name as aforesaid, declares the
said paper writing so subscribed by him and
exhibited to be his last will and testament,
and this deponent did thereupon subscribe his
name at the end of said will as an attesting
witness thereto, and at the request and in the
presence of said testator.
And this deponent further saith that at
the said time when the said testator subscribed
his name to the said last will and testament as
aforesaid and at the time of deponent's
subscribing this name as an attesting witness
thereto as aforesaid, the said G. W. Whitmire
was of sound mind and memory, of full age to
execute a will, and was not under any restraint
to the knowledge, information, or belief of
this deponent and further these deponents say
not.
