- This
Indenture made this 13th day of
August in the year of our
Lord 1825 Between Zachariah
Candler of the one part
and Benjamin
Wilson of the other part both of the State
of North Carolina
& county of Buncombe. Witnesseth that
for the sum of one
hundred & fifteen dollars to me in hand
paid by Benjamin
Wilson that I Zachariah Candler have this
day Bargained &
Sold and do by these presents bargain &
sell &
convey &
confirm unto him the aforesaid Benjamin
Wilson his
heirs and assigns
forever the following tract or parcel of
land situated in
the aforesaid state & county on both
sides of Catheys
Creek of French Broad river joining a two
hundred acre tract
of land granted to Joseph Morgan whereon
the said Benjamin
Wilson now lives Begining on a
____ed poplar (now
fell down) on the south Bank of said
creek Morgans old
Begining corner then turns south with
said line sixty
poles to a black walnut tree near the bank
of that mill creek
Wm. Wilsons corner of fity acres thence
south as before
with that line eighty poles to a white oak
his S.E. corner in
a flate thence West with his other
line one hundred poles
to stake & ______ Wilsons S.W. corner
there North with
his other line eighty poles to small black
oak at Wilsons N.W.
corner in Joseph Morgans old line then
west with that line twenty four
poles to a spanish
oak Morgans old
S.W. corner, thence North fifty five
west along the top
of a ridge two hundred and fifty
poles to 2 chesnut
trees on a high point of the Ridge then
North crossing the
Mill creek one hundred & sixty five
poles to a Stake
thence East two hundrd & sixty five
poles to a locust
and maple & chesnut near the east Bank
of Catheys creek
& at or near Wilsons old N.W. corner
thence North
thirty East eighty poles to a hickory on a
Ridge then East
one hundred and twenty eight poles to 2
black gums on a
flate ridge thence South twelve
East thirty
three poles to 2
red oaks at the N.E. corner of two hundred
acres granted to said
Candler then South twelve West as
before one hundred
poles to a pine on a ridge Candler
begining corner
then South thirty East with that line
thirty one poles to a
red oak John Duckworths corner of the land
that said Candler
sold to him then with Duckworths said line
south westerdly
along the main top of the ridge that
divides the Glady
branch from Catheys creek to a stake in
Joseph Morgans old
line then south with that line to a stake
in James Millers
old line then west ten poles to the
begining with said
lines Bounded all round two hundred
acres Granted to
Joseph Morgan [Some
of the above is repeated and then marked
out here - LOA] & about
six acres conveyed by said Candler to the
Baptist church on
the south side of said creek which two
tracts is herein
excepted in the whole supposed to
contain four
hundred acres more
or less Exclusive of the aforesaid two
tracts the same
being a part of two tracts granted to said
Candler & a
part of a large tract granted to David
Allison as
will more fully
appear by the registers office and the
aforesaid Zachariah
Candler do by these presents oblige himself
& his heirs
executors & administrators to warrant
and forever defend
the aforesaid tract of land with all its
appertenances whatever
thereunto belonging all except the
aforesaid six
acres to the Baptist church & two
hundred acres
to Joseph Morgan
free & clear from himself his
heirs &
assigns Executors administrators or the
lawful claim
& claims of
all & every person or persons claiming
under him
or them and no further unto the aforesaid
Benjamin Wilson
his heirs & assigns Executors &
administrators
forever. In
witness whereof the aforesaid Zachariah
Candler
has hereunto set
his hand and seal this day & date above
written.
